Employment Background Check Reminders
 
Authorization and Disclosure Forms: This is a hot topic in class-action lawsuits. The sample forms Eide Bailly provides are up-to-date and meet the requirements of the FCRA. Please follow these simple do's and don'ts with your forms:
 
DON'T:
  • Change the format
  • Number the pages
  • Condense the number of pages
  • Remove the [End of Document] Page 1 of 1
DO:
  • Add in the employer name throughout
  • Remove the disclaimer prior to providing to candidates

Adverse Action Process: Adverse action is a denial of employment or promotion based on the results of the information found in a consumer report. When taking adverse action based on a consumer report from the CRA, the end user MUST provide oral, written or electronic notice of the action being taken to the consumer. Eide Bailly can assist with providing sample letters and the proper procedure to use in your hiring process if an adverse hiring decision will be made.
