Are You in Compliance with the Telephone Consumer Protection Act?

On July 10, 2015, the Federal Communications Commission released a Declaratory Ruling and Order which addressed several revisions to the Telephone Consumer Protection Act (more commonly known as TCPA). The full ruling may be found under the title of FCC 15-72. The TCPA was first introduced in 1991 and has since been revised in 2003 and again now in 2015. It provides regulation of the use of autodialer phone systems while providing protection to the public to consent or opt out of calls of this nature. The most recent revision also addresses the use of auto-generated texts and pre-recorded messages. For health care organizations, this can include appointment reminder, HCAHP survey and collection calls. The responsibility for consent as well as providing a mechanism to opt-out of such calls falls to the organization initiating these calls, either through their own technology or use of a third-party organization providing services on their behalf.
