Credit Report Update: New York Prohibits Employers from Using Credit Information in Employment

 

With bill Intro-261-A that was passed on April 16, 2015, New York City will become the 12th jurisdiction in the country to prohibit employers from using credit checks to screen job applicants, joining California, Colorado, Connecticut, Hawaii, Illinois, Maryland, Nevada, Oregon, Vermont, Washington, and the city of Chicago. Updates to Background Reports

There have been a couple changes within the industry that affect how we process background reports for our clients:

  • Credit Reports - If you currently request credit as part of your background report, you will see a change. You will receive two reports, one with the credit and the second with the background report.

  • Section 613 letters - Due to recent legal activity, our attorney has advised us that any time there is adverse information on a background report and/or if we receive information from a public site, a Section 613 letter will be sent from Eide Bailly to the subject. If you get calls from your candidates, you can assure them this is a formality of having their background check completed by a Consumer Reporting Agency (CRA). 

Recognition of New Certifications

Eide Bailly's Megan Bowar, backgrounds associate, passed the Advanced FCRA Certification Exam, and Michaela Dye, backgrounds associate, passed the Basic FCRA Certification Exam.

 

These certifications are an important step in assuring clients that reports are accurate and in compliance with FCRA guidelines as a Consumer Reporting Agency (CRA).
