Case Study - EEOC Criminal History Guidance

A background check was requested by a company that was going to be hiring for an entry level position and the results came back with two criminal hits of theft from the 1980s. Since it was reported by the State of North Dakota, which allows consumer reporting agency's to report indefinite dispositions of convictions, we were able to share the criminal history with the client for employment purposes. Once the information was received, the client needed to start the individualized assessment process. The results from the assessment showed that there was rehabilitation since the criminal acts and the candidate had not reoffended since the 1980s, therefore, an adverse hiring decision was not made. The candidate was hired for the position.
 
When reviewing criminal history, keep in mind the EEOC Guidance to stay in compliance while making your hiring decisions. In addition, remember these three factors when you are preforming an individualized assessment, 1) the nature and gravity of the offense or conduct; 2) the time that has passed since the offense, conduct or completion of the sentence; and 3) the nature of the job held or sought out.

Megan Bowar, and her husband Matt, welcomed their baby girl, Finley Marie, on Saturday, May 31. Megan will be out of the office on maternity leave and will return in August.
