Is it Time to Revise Your Employment Application?
Effective January 1, 2014, Minnesota joined a number of states that have enacted legislation limiting an employer's ability to ask job applicants about criminal records. Under this law, employers are prohibited from asking about an applicant's criminal history on an employment application. Instead, an employer must wait until an applicant has been selected for an interview before inquiring about criminal history.
Current states that adopted Ban the Box policies: Minnesota, Hawaii, California, Illinois, Maryland, Rhode Island, Colorado, Massachusetts, New Mexico and Connecticut, including 53 cities and counties.
Who is exempt from Ban the Box? The group that this will not impact is employers who are required to consider criminal history in hiring for specific types of employment - occupations, including employees working with children, social workers, private detectives, health care workers, banks and other financial institutions.
Fines
Private employers who violate this statute may be subject to fines between $500 and $2,000 per violation, depending on the size of the employer.
