BIRS Software Enhancements
With the Background Information Reporting System (BIRS) software update implementation on July 29, it added a few additional features:
Password Changes - This will allow you to change your password when prompted every 90 days. You will need to set up a security answer and question. We suggest you do this right away so that it won't hold up future requests when logging on. Also note, after three failed attempts of trying to log on, you will be locked out of your account. Please contact us to have your account unlocked.
Viewing Results - This new feature allows you to click on the plus sign to the left of the applicant and preview the information without printing it. You will also be able to select the folder on the right and move it to the archives.
Save as Draft -This option allows you to save the information you have entered and return later to complete. This may be one of everyone's new favorite features; no more losing data you already entered.
Case Study (Credit)
Effective July 1, 2013, Colorado was the 9th state to restrict an employer's right to use credit reports in employment decisions. Colorado joined California, Connecticut, Hawaii, Illinois, Maryland, Oregon, Vermont and Washington in enacting legislation to restrict employer's ability to use credit information in employment. Additional states have similar pending legislation.
Exceptions for Colorado
For those who are entitled to a credit report or may only request and use a credit report if it is "substantially-related to the position" being filled. If a credit report is obtained under the substantially-related use, then the employer must provide to the applicant/employee a notice that a credit report will be obtained. A special notice is not required for employers of banks, financial institutions or those required by law to obtain credit reports.
The Equal Employment Opportunity Commission (EEOC) has indicated that it will be stepping up its efforts to remove likely barriers of employment, including the use of credit information in employment. Given these changes, all employers should be aware of their policies, in this respect, and keep up-to-date on changes in this area. Our current clients have taken additional steps to review policies and job descriptions; making necessary changes to comply with requesting credit reports for an employment purpose.

This certification is an important step in assuring clients that reports are accurate and in compliance with FCRA guidelines as a Consumer Reporting Agency (CRA). |
