As summer winds down, we hope you have been able to enjoy more leisurely activities such as vacations, outdoor activities and perhaps home or yard improvement projects. 
 
In this issue of The Monitor, we focus on the important issue of workplace safety, specifically regarding an employer's right to know about the criminal background of potential employees. Our main article highlights the alarming recidivism rates of persons who have done jail time only to get re-arrested for the same or different crime. 
 
But equally as alarming - and since many of you reading this eNewsletter are also consumers - we feature an article about the safety of your home and family in hiring service workers in your home or on your property. 
 
Lucia Bone founded the Sue Weaver CAUSE because her sister was murdered by an in-home service worker. The killer, a repeat sex offender, was subcontracted by a reputable, large department store and returned six months after completing the work in order to rape and beat her to death. Lucia has turned this terrible tragedy into her life's work and is conducting a crowdfunding campaign to help fund education and awareness of the importance of thorough background screening.

Reintegration into society for individuals with a prior criminal record should be fair and balanced for all parties involved. Ignoring workplace safety and limiting an employer's use of background checks should not be the focus of reintegration efforts.
 
Securing a steady job is a key component of reintegration. Programs to help with drug and alcohol addictions, mental health issues, and educational or vocational training would be very beneficial for those with prior criminal records, their families and society as a whole. However, the focus should be on rewarding employers who can and do hire those with prior records rather than punishing those employers who cannot.
 
The White House's Fair Chance Pledge represents a welcome, holistic approach to helping the formerly incarcerated get back to work. The Pledge, for example, urges businesses to thoughtfully and voluntarily assess their internal hiring practices in order to consider ways in which they can eliminate biases and find potential roles for those with a criminal past in their workforce. It doesn't mandate restrictions on businesses but, instead, seeks buy-in and collaboration.

Over the last several years, laws have been enacted at various jurisdictional levels that serve to limit an employer's rights when it comes to vetting the background of their potential employees. Lawmakers, in their well-meaning eagerness to "level the playing field," have nearly taken employers completely out of the game. They need only look at two of their own studies to understand how important background screening is to an employer's ability to assess and mitigate risk.

an in-home service worker

Sue Weaver, a well-educated business woman with an MBA running a successful embroidery company in Florida, had contracted with Burdine's, a premier department store chain in the state, to have the air ducts in her home cleaned. Unbeknownst to her, both of the men sent on the service call had criminal records - one was a twice-convicted sex offender on parole.
 
Six months after the service work was completed, the sex offender returned to Sue's home to rape and beat her to death. He then set her home on fire with the intent of destroying any evidence.
 
Years after her sister's horrific death, Lucia Bone founded the Sue Weaver CAUSE (Consumer Awareness of Unsafe Service Employment), a nonprofit organization dedicated in Sue's memory.  Lucia believes Sue's murder could and should have been prevented. 
 
"Through education, awareness and advocacy, CAUSE works to prevent tragedies like Sue's from happening to others," states Lucia.  It is our hope that her story will raise awareness for both consumers and employers on the dangers of not knowing who you hire."
