I love this time of year. The flowers are in bloom, the weather is warmer.....but now more than ever I am happy to see legislators take a summer vacation! Things have been very busy on the background screening front. The number of bills introduced at the federal, state and local levels has been tremendous. Luckily not all have passed, but several have and are included in this newsletter to keep you abreast of the laws related to the background screening industry.
After reading this eNewsletter, I suggest consulting with your employment attorney to make sure your hiring and screening procedures are compliant. The Hire Image team is always available to help you wade through the implications, but we cannot offer legal advice.
We are happy to have a guest article from Michael Klipper, partner at Washington DC law firm of Meyer Klipper Mohr PLLC, discussing the importance of ex-offenders reintegrating into society, but not at the expense of employers properly screening their workforce. Michael and I have gotten to know each other very well while working together to protect the rights of employers to conduct background screens. I am honored to have him provide his insight to all of you. He is a both a mentor and a friend, and I know you will appreciate his take on the EEOC guidance on criminal background checks.

U.S. Commission on Civil Rights Inundated by Comments on EEOC Guidance
The U.S. Commission on Civil Rights (USCCR) held a briefing in December to assess the impact of criminal background checks and the EEOC's guidance on the consideration of arrest and conviction records in enforcement decisions under Title VII and its impact on the employment of black and Hispanic workers. Hire Image, along with the National Association of Professional Background Screeners (NAPBS) and many other like-minded organizations, signed a letter to the commission to provide insight into the defects of the Guidance - defects that discourage responsible use of criminal background checks. The letter was quite lengthy but highlighted the lack of transparency in issuing the guidance as well as the failure to weigh the important societal interests served by criminal background checks. The USCCR received so many letters that they have been unable to post them online.

EEOC Guidance on Criminal Background Checks Needs Revision- Particularly when it comes to ex-offender re-entry into the workforce

Last year, the EEOC published a document entitled, "Enforcement Guidance on the Consideration of Arrest and Conviction Records in Employment Decisions under Title VII of the Civil Rights act of 1964," that outlines policies and procedures for companies and nonprofit organizations that use criminal background checks to screen employees. It replaced a simple, three-page document that employers had relied on for decades with 50-plus pages of often confusing and unwieldy bureaucratese. As a broad group of employers, screeners and volunteer groups noted, the document, while well-intentioned, is likely to discourage the responsible use of criminal background checks and may result in practices that endanger the safety of people and property in workplaces across the country.
The Guidance addresses an issue of great importance to our society: How do we help ex-offenders successfully re-enter the workforce.
