"Yelp Trial" Injunction, Retrial Denied in Case's Final Conclusion

As we told you about earlier this year, a remodeling contractor sued a former client, Jane Perez, for defamation over negative reviews on Yelp and Angie's List that alleged the contractor stole jewelry, trespassed and performing shoddy work.

The trial ended in a stalemate in March, with Perez having removed the reviews and the contractor not being granted an injunction to keep the consumer off of internet reviewing sites. The Judge felt that both sides had defamed each other, and awarded no restitution to either party.

However, the presiding judge, David S. Schell, had some harsh words for Perez: "In my judgment, Ms. [Perez] caused havoc and chaos by her malicious and untrue statements," said Schell, adding that, "none of this would have happened if Ms. Perez had just posted the truth."

NARIGC to Host OSHA, RRP Programs This Year
 
With both OSHA and the EPA  ramping up enforcement of Safety and Lead Paint issues, NARIGC wants to make sure you have the opportunity to be as informed as possible to help avoid programs.  Please take this brief survey so we have an idea of how many people to expect.

OSHA 10-Hour
The OSHA 10-Hour course provides training for entry level workers and employers on the recognition, avoidance, abatement, and prevention of safety and health hazards in workplaces in Construction industry. The program also provides information regarding workers' rights, employer responsibilities, and how to file a complaint. Through this training, OSHA helps to ensure that workers are more knowledgeable about workplace hazards and their rights. This course, per OSHA regulations, will be held over two days for a total of 10-hours. (Approximate cost: $150 per person)
 
RRP Refresher Course
If you became "Lead Certified" when the RRP Rule first went into effect, your certifications will expire within the next year.   The EPA says that you can take the course anytime before your certification expires; however, once your certification expires, you are no longer eligible for the refresher course and you will have to take the full Lead Certified course again.  (Approximate Cost: $175 per person)
 
RRP/OSHA Paperwork Workshop
This will be a workshop on both RRP and OSHA paperwork that every contractor should have in place and up-to-date in case the EPA or OSHA comes knocking on your door.  Both EPA and OSHA are levying fines on contractors who don't have their paperwork in order.  (Approximate cost: $95 per person)
