ILLINOIS HOUSE INTRODUCES MECHANIC LIEN-WRITTEN CONTRACT BILL (HB 5663)

The Illinois House of Representatives introduced HB5663 last week (click here for info about the bill), which requires a written contract to be in place in order for anyone performing improvements to a property to be entitled to mechanic's liens.  As of last week, it was referred to the House Rules Committee.

This bill does not take into consideration subcontractors and suppliers, given they have no control over the existence or non-existence of a written contract between the general contractor and the owner and, in fact, will usually not know if such a written contract exists.  It is also unfair to the general contractor who performs in good faith under an oral contract.

Please contact your State Representative (a list of current Representatives can be found here) and ask them to oppose this bill for the reasons stated above.
