Obama Administration Issues Final Regulations and Guidance for "Fair Pay and Safe Workplaces" (aka "blacklisting")
On August 24th, the U.S. Department of Labor and the Federal Acquisitions Regulatory Council announced final regulations and guidance implementing the Fair Pay and Safe Workplaces Executive Order (EO).
Signed by President Obama in July 2014, the EO requires contractors seeking federal contracts worth $500,000 or more to disclose any violations they committed, during the previous three years, of 14 Federal labor laws and Executive Orders, as well as equivalent State laws. This includes any violations addressing wage and hour, safety and health, collective bargaining, family and medical leave, and civil rights protections. The rule gives Federal agencies guidance on how to consider labor violations when awarding federal contracts. This final rule and guidance implement the EO. Unlike the proposed rule, the final phases in the requirements starting in October 2016.
Although NECA still has serious concerns about the overall intent of the EO, the final rule accepted a suggestion by NECA to allow subcontractors to report any qualifying labor law violations to the Department of Labor directly, instead of reporting to prime contractors, as proposed initially. "Fair Pay" Rules
In addition to the new "Fair Pay" rules, there is still pending a final rule by an Executive Order requiring Federal contractors to provide Paid Sick Leave to their employees, even if they are covered by a collective bargaining agreement. This forthcoming rule, combined with the "Fair Pay" rule, is sure to add new headaches to electrical contractors who do federal work. In addition to imposing administrative burdens, both rules have significant implications for union employers.

The election process for the Chapter's Board of Directors has begun. This year there are seats available in our Alameda, Modesto and Stockton Divisions. Fall General Member Meeting

The end of summer is quickly approaching, which means it's time for the Northern California Chapter's Annual Fall General Member Meeting on Tuesday, September 13th. We will be returning to the Palm Event Center in Pleasanton, 1184 Vineyard Ave. The evening's reception will begin at 6PM with hosted hors d'oeuvres and beverages. Along with networking and our popular raffle prize drawing, we will also recognize our Chapter contractors and their team members with Project Excellence Awards. The NECA/IBEW Joint Safety Committee will present the Marv Jensen Safety Award designed to recognize excellence in safety demonstrated by NECA contractors and IBEW electricians. We are pleased that Marco Giamberardino, NECA National's Executive Director of Government Affairs, will join us to shed light on what he and his staff do daily to promote the union electrical industry. Marco attended the Republican and Democratic National Conventions and will shed light on what has been a very interesting political climate. We hope to see many of you there.
