Berkeley Ordinance Requires Contractors to Submit Proof of Payment  
On July 19th, the City of Berkeley enacted what it calls the nation's first law requiring contractors to prove they paid construction workers before they can get a permit allowing the building to be occupied. The Berkeley City Council unanimously adopted the requirement for contractors to submit proof they paid the construction workers and informed them of their rights before the City will issue a certificate of occupancy. The requirement is aimed at preventing workers from getting stiffed by contractors who disclaim any responsibility for paying workers after the work is done.

The Berkeley law will ensure compliance with the California Wage Theft Protection Act "by requiring confirmation by owners, contractors and subcontractors of the rate of pay and other legally required information regarding mandatory and voluntary fringe benefits" under Labor Code § 2810.5, the ordinance says. The law covers new construction of more than 30,000 square feet on projects not subject to local, state or federal prevailing wage requirements or that don't have a valid project labor or community workforce agreement.

The local labor-backed law fills a hole in state wage theft enforcement by putting the onus on contractors seeking to get the city to sign off on a project so they can start filling buildings with paying occupants. Thirty days after getting a building permit, and every 30 days thereafter, contractors or subcontractors whose portion of the work exceeds $100,000 or 1% of the project's value must attest to the city that workers received notices and wage statements that are compliant with state law. Within 10 days of project completion, contractors and subcontractors must submit an updated list of the portions of construction and demolition work broken down by subcontracts and an updated and final list of the complete names and Contractors State License Board license numbers of entities that worked on the project. If Berkeley confirms compliance and affirms that the state Labor Commissioner's Office didn't cite the project for not paying workers, it will then issue a certificate of occupancy.

California annually loses $8.4 billion to $28 billion in unpaid income, insurance and sales taxes from the underground economy, the state Department of Industrial Relations estimates. The construction industry is second only to restaurants in labor standards violations as measured by state labor commissioner fines, the Berkeley law said. Wage theft affects roughly one in six California construction workers, or about 144,000 workers.

Construction workers who don't receive all of their wages and mandatory benefits "are likely to discover that despite the best efforts of State enforcement officials, many employees continue to be victims of wage theft because they are unaware of their rights or the State lacks adequate resources to advocate on their behalf," the Berkeley law said. The measure was sponsored by Councilmember Laurie Capitelli.

Solano/Napa Counties JATC Hires New Training Director 
On June 1st, the Solano/Napa Counties Joint Apprentice & Training Committee (JATC) hired Jack Paulson to replace Skip Lucier as Training Director. Skip retired effective May 31, 2016, and Jack assumed the position on June 1, 2016.

Jack enrolled in the apprenticeship in 2002, where he served as an Apprentice Liaison with the JATC from 2003 thru 2007. Also during that time, Jack was in charge of the retiree program where apprentices helped Local 180 retirees with various tasks such as yard work and maintenance around their properties. After completing the apprenticeship program in 2007, Jack was appointed to represent Labor on the JATC Trust from 2007 thru 2010. Soon thereafter, Jack became an Instructor teaching OSHA-10 and OSHA-30. He also became the Training Instructor for Local 180's CE/CW Program.

We would like to congratulate Jack on his new position. We have every confidence he will take the program to the next level of education and training.

Job fairs provide an opportunity for non-union electricians and those interested in a career in the industry to speak with Organizers in a relaxed atmosphere, and meet directly with employers. Employers can gauge an individual's skill level and determine if they would be a good fit for their company. Two job fairs will be held in August - one on August 16th at the Training Center in Stockton, and another on August 30th at the ZNE Center in San Leandro. Fall General Member Meeting 
Tuesday, September 13th
Invitations have been emailed for the Northern California Chapter's Fall General Member Meeting coming soon on Tuesday, September 13th. This year's event will be held at the Palm Event Center in Pleasanton, 1184 Vineyard Avenue. The evening's reception will begin at 6:00 PM with hosted hors d'oeuvres and beverages. Along with networking and our popular raffle prize drawing, we will also recognize our Chapter contractors and their team members with Project Excellence Awards. The NECA/IBEW Joint Safety Committee will present the Marv Jensen Safety Award designed to recognize excellence in safety demonstrated by NECA contractors and IBEW electricians. We are pleased that Marco Giamberardino, NECA National's Executive Director of Government Affairs, will join us to discuss what he and his staff do daily to promote the union electrical industry. Marco attended the Republican and Democratic National Conventions and will shed light on what has been a very interesting political climate.

DIR Resumed Enforcement August 1st 
On August 1st, the Department of Industrial Relations (DIR) resumed enforcement of the requirement to submit certified payroll records using the DIR's online system. Public works contractors and subcontractors must comply.

The requirement to keep certified payroll records (CPRs) has not changed and the electronic certified payroll reporting system is now fully operational. The enhancements to DIR's online system consists of a simplified online filing form. The requirements for uploading payroll records via XML remain unchanged. New user guides and video tutorials with detailed instructions will accompany the release of the enhanced system.

DIR has additional compliance information on its Public Works page. The public works community is also invited to subscribe to email alerts on public works topics, DIR press releases and other departmental updates.
