Know Your Agreement
Category I Language 
All Inside Construction Agreements between IBEW Local Unions and NECA Chapters must contain all Category I Language verbatim. Category I Language is Standard Agreement Language approved and adopted by the IBEW International and National NECA. Following are two such Category I provisions that are included in all Agreements:

The 48-Hour Clause states that:

"If the Registration list is exhausted and the Local Union is unable to refer applicants for employment to the Employer within 48-hours from the time of receiving the Employer's request, Saturdays, Sundays and holidays excepted, the Employer shall be free to secure applicants without using the Referral Procedure but such applicants, if hired, shall have the status of 'temporary employees.'"

A 'temporary employee' provision states that:

"The Employer shall notify the Business Manager promptly of the names and Social Security numbers of such 'temporary employees' and shall replace such 'temporary employees' as soon as registered applicants for employment are available under the Referral Procedures."

An example of the 48-Hour Clause would be if you were requesting a journeyman wireman for a job. The employer would contact the dispatch office requesting the number of journeymen needed. If the Local is unable to provide such applicants within 48-hours, then the employer has the right to secure an applicant without using the Referral Procedures.

Once the employer finds such applicant, the employer must contact the Local notifying them of the applicant's name and Social Security number. This applicant will then be considered a temporary employee. As soon as an applicant becomes available under the normal Referral Procedures, the employer must layoff the temporary employee and hire the available applicant under the Referral Procedures.

Please note, it is the responsibility of the employer to comply with the steps of each provision in order to stay compliant with the Collective Bargaining Agreement. If you have any questions regarding either provision, please do not hesitate to contact the NorCal Chapter Office.

OSHA Scam
The feds are on the hunt for fraudsters posing as workplace safety inspectors who try to bamboozle businesses into paying fines for phony rule violations. Scammers commonly pose as officials with the Occupational Safety and Health Administration and write up firms for not displaying required OSHA posters and other infractions. One such operation in Florida swindled unwitting small businesses out of $1.3 million. The Federal Trade Commission is stepping up its efforts to prosecute OSHA impersonators.

Businesses can avoid getting conned by staying on the lookout for scammers. If an inspector shows up at your firm unannounced, or if you receive a call or e-mail from someone claiming to be with the agency, call your local OSHA office to make sure that the visit or message is real. OSHA will understand...it knows about the scams.
