Local Union 595-W Negotiations Concluded
Effective June 1, 2016
Negotiations for the Local 595-W Inside Construction Agreement concluded with a joint recommended settlement approved by the members of Local Union 595. Attached is the Labor Bulletin outlining the settlement. The three-year agreement will commence on June 1, 2016, with a $2.53 increase allocated as follows:
  • $2.00 to the Wage
  • $0.50 to the Money Purchase Pension Plan
  • $0.03 to the LMCC

Future increases include $2.55 effective June 1, 2017, and $2.60 effective June 1, 2018. Click here to see the updated Cost Data Sheet for Alameda County, Local Union 595-W.

Local Union 595-E Rate Updates 
Effective June 1, 2016 
The membership of Local Union 595-E has allocated its $1.25 increase effective June 1, 2016, under the Local Union 595-E Inside Agreement as follows:
  • $0.50 to the Wage
  • $0.50 to the Health & Welfare and $0.25 to the Health Reimbursement Account (HRA). This brings the total Health & Welfare contribution rate to $14.79

Annual Legislative Conference Held Last Week
A contingency of seven participated in NECA's annual legislative conference held last week: Kurt Brinkman (Intrepid Electronic Systems); Lew Frain (Con J. Franke Electric); Gary Woody (Bockmon & Woody Electric); Greg Long (Long Electric); Andre Gardner (NCECI); and representing the Chapter, Greg Armstrong and Darlene Besst. The conference featured congressional guest speakers who enlightened us on key issues being discussed on Capitol Hill.

All of us had an opportunity to meet with our Chapter area representatives to discuss issues relevant and critical to the success of the electrical contracting industry. We always appreciate when a Member of Congress is able to 
carve time out of his/her busy schedule to meet with us. This year meetings were held with Jim Costa, Jeff Denham, John Garamendi, Mike Honda, Barbara Lee, Tom McClintock, Jerry McNerney, Eric Swalwell and Mike Thompson. The key issues discussed with our representatives included repeal of the 40% transitional fee associated with the American Health Care Act (including the need to remove a transitional fee for Taft-Hartley plans); Permanent Relief for Multi-employer Pension Plans; Misclassification of Employees as Independent Contractors; Paid Sick Leave for Federal Contractors; and encouraging our representatives to join the new Congressional Building Trades Caucus, a bipartisan collaboration in the House that will advance the agenda of a skilled and hardworking workforce.

Our conversations were enhanced by our contractors who conveyed what they are faced with as owners of small to medium size businesses. Our visits to Washington, D.C. as well as local contact with our representatives have allowed us to develop what have become well-established relationships with our congressperson. We found them to be very open to our concerns and asks. NECA's Government Affairs team in Washington, D.C. will hold follow-up meetings. Our Chapter will also schedule local follow-up meetings over the next few months.

DOL Issued Long-Awaited Overtime Rule
Exempt Employees 
The Department of Labor (DOL) issued the long-awaited final overtime rule updating overtime regulations. The rule increases the salary threshold for exempt employees from the current $455 per week ($23,660 annually) to $913 per week ($47,476 annually), less than the expected $50,440.

The FLSA Overtime Rule At-A-Glance
  • The rule extends overtime protections to 4.2 million workers who are not currently eligible under federal law.
  • Workers who earn as much as $913 a week ($47,476 annually) will have to be paid overtime, even if they are classified as a manager or professional.
  • Employers must comply with the new regulations by December 1, 2016.
  • The DOL will automatically increase the salary threshold every three years. Based on current projections, the salary threshold is expected to rise to more than $51,000 with its first update on January 1, 2020.

Despite early predictions, the final rule does not make any changes to the duties test for executive, administrative and professional employees.

 

Options for Employers to Comply With the Rule:

  • Reclassify exempt employees to hourly and cap their hours to 40 per week;
  • Reclassify exempt employees to hourly and pay time-and-a-half for hours worked above 40 in a week;
  • Raise workers' salaries to at or above the new threshold to retain the exemption; or
  • A combination of the above
