Two Important Sick Leave Laws for Employers
Effective in 2015
California Sick Leave Law Effective July 1, 2015:

The "Healthy Workplace, Healthy Family Act of 2014" (California Sick Leave), went into effect on July 1, 2015. This law will affect your part-time and full-time non-bargained employees who are not covered by the Collective Bargaining Agreement, and it also affects your bargained employees when they are working in IBEW Locals 551 and 234, as these areas were not able to negotiate the clause out of the CBA. A few key highlights of this sick leave law are:
  • Employees will start accruing sick leave after 30 days of employment. However, they can start using the accrued sick leave after 90 days of employment.
  • As an Employer, you have two options:
    • Accrual Option: This allows the employees to accrue 1 hour of sick leave for every 30 hours worked. As an employer, you can limit the total accrual of sick leave to no more than 48 hours, or 6 days. As an employer, you can also cap usage of sick leave to 3 days per year.
    • Lump Sum Option: This allows the employer to give their employees no less than 3 days at the beginning of each year. The employees have 12 months to use the days given.
  • Any accrued or unused sick leave must be restored to an employee if they return to the same employer within 12 months of separation.
  • Employers must show how many days of sick leave are available. This may be done on the employees pay stub, or on a separate document issued the same day as the paycheck.
  • Employers must keep records showing how many paid sick days employees have earned, and used, for 3 years.
  • Finally, a Paid Time Off (PTO) policy that meets the minimum requirements of the California Sick Leave law, may continue to be used. So, if your company previously provided employees with 5 days of PTO each year, you would not have to supply your employees with 3 additional days of sick leave.

Oakland Sick Leave Law Effective March 2, 2015:

Measure FF in Oakland went into effect on March 2, 2015.  This law affects your part-time and full-time non-bargained employees who work in Oakland, for at least 2 hours in a given workweek. It does not affect your bargained employees, as the Alameda County (Local 595) CBA specifically states, "No compensation for sick leave, personal time off, vacation, and/or holidays shall be required except as stipulated in this Agreement." A few key highlights of this law are:
  • Employees will start accruing sick leave on the first day of employment with your company. However, they can start using the accrued sick leave after 90 days of employment.
  • As an Employer, you only have one option:
    • Accrual Option: This allows employees to accrue 1 hour of sick leave for every 30 hours worked. As an Employer, you can limit the total accrual of sick leave to no more than 72 hours, or 8 days. If you are a small employer - one that employs an average of 10 people each week - you can limit the total accrual of sick leave to no more than 40 hours, or 5 days. Again, there is no other option, so you cannot give employees 8 hours of sick leave at the beginning of each year.
  • Employers are required to provide a copy of the records to an employee upon the employee's reasonable request.
  • Employers must keep the records showing how many paid sick days employees have earned, and used, for 3 years.
  • A Paid Time Off (PTO) policy that meets the minimum requirements of the Oakland Sick Leave law may continue to be used. So, if your company previously provided employees with 8 days of PTO each year, you would not have to supply your employees with 8 additional days of sick leave.

Another thing to note, if both laws apply to your company, you must follow the law more beneficial to the employee.

The US Treasury and Internal Revenue Service has issued Notice 2016-4, which extends the due dates for the 2015 Information reporting requirements, both furnishing to individuals and filing with the IRS.

Education Fund Credits for 2015
Deadline to Submit: January 31, 2016
Remember to submit your reimbursement request for meetings and events attended in 2015. The deadline to submit for your 2015 education fund reimbursement is January 31, 2016. An accounting of remaining education fund credits was sent to each Chapter member in December. Take advantage of this member-only benefit and submit for your reimbursement before the deadline. First Aid/CPR Training, Dublin
On-Site Health & Safety will be conducting a First Aid & CPR training course at the IBEW Local 595 Union Hall, on January 21, 2016.  The class will cover basic fundamentals of both first aid and CPR. Attendees will receive a certification card for participating in this valuable training, which is valid for two years.

Future Forecast Seminar
