Change Order Reform Legislation   
Final Committee Hurdle For NECA Sponsored Legislation, Meeting Today
NECA-sponsored legislation to ensure contractors are paid timely for "change order" work has been voted out of its final committee. AB 1347 puts a fair and responsible process in place that requires agencies to respond to a contractor's claim for "extra work" timely, and provides a path for expedited settlement of disputed claims. Last week, the Senate Appropriations Committee voted to move the bill to the Senate floor despite heavy opposition from State agencies who continue to insist the bill will cost tens of millions of dollars to the State. Their argument is that having to review and respond to claims in a timely manner will require them to hire additional contract management staff. To get the bill out of committee we negotiated to make the bill a pilot program of three years that can be extended after the effectiveness of the process has been demonstrated.

A meeting will be held at the Governor's office today, and this will be the last time that NECA has an opportunity to show them how much the industry supports this critical bill. State agencies are putting a lot of pressure on Governor Brown, so we are cautiously optimistic. More to come soon!

Paid Sick Leave For Federal Contracts  
Effective January 1, 2017
On Labor Day, President Obama signed an Executive Order requiring federal contracts to offer their employees up to seven days of paid sick leave per year. This Executive Order will take effect after January 1, 2017, and requires that workers on federal contracts earn a minimum of one-hour of paid sick leave for every 30 hours worked.  
 
This is different from the Health Workplace Health Family Act of 2014, otherwise known as the California Sick Leave Law, as it extends to all employees, both collectively bargained and non-bargained. NECA will continue to review the Executive Order and will provide more information as it comes forth.

Wage Theft, Other Bills Sent To California Gov.
SB 588
On September 11, a bill that would give the California Labor Commissioner more tools for collecting unpaid wages on behalf of workers was one of several labor and employment measures lawmakers sent to the desk of Governor Brown before adjourning for the year.
 
SB 588, by Senate President Pro Tempore Kevin de Leon (Los Angeles), would give the commissioner the authority to file a lien or levy against an employer that failed to pay wages owed under a final court judgment. An employer failing to pay wages within 10 days of a levy would be required to stop operations or secure a surety bond of $50,000 to $150,000 depending on the size of the unpaid judgment. Senator de Leon said the bill targets a two-fold problem of employers that fail to pay wages, and the difficulty workers face collecting the wages even after winning judgments against employers.
 
"With SB 588 we can give the Labor Commissioner the tools necessary to enforce the law for the workers and target the bad actors to level the playing field for honest businesses," de Leon said.
 
The Governor has until October 11 to sign or veto the measures.

He will speak about significant changes in the 2014 National Electrical Code (NEC) and changes coming in the next edition of the NEC-2017. - Individuals should have a firm grasp of basic estimating principles and experience preparing bids

This course was developed to discuss all phases of the estimating process, this course covers all phases of preparing a competitive bid. Key topics include identifying desirable bid opportunities, analyzing the company's capabilities to insure profitable results, the estimator's role at various stages of the project, writing an effective scope letter, and identifying often hidden costs in the bid documents.
Following this class, participants will be able to:
  • Discuss the steps necessary to prepare a competitive bid
  • Identify the most desirable bid opportunities
  • Describe how a company's capabilities can be analyzed to insure profits
  • Discuss cash flow and bonding
  • Discuss relevant contract terms
  • Identify price adjustment techniques, overhead, and profit
