The Project Manager/Witness class scheduled in Dublin on June 25th has been cancelled. Instead, the Solano & Napa Counties Electrical Contractors Trust will hold one class in Napa on June 24th. There is still room and time to register. Don't miss the opportunity to get your managers trained in every step of the management process vs. taking on the role of a project witness. Project Managers are a critical component for every contractor, and providing them with the foundation of management expertise will equip them to direct the entire project life cycle. Questions? LEED Exam Training Workshop

The Solano & Napa Counties Electrical Contractors Trust is hosting a LEED Green Associate Exam Training Workshop on July 23rd, at the Napa Training Center, 720 Technology Way. GreenStep will present a full-day workshop of instruction related to training for the LEED Green Associate Exam, focusing on key information necessary to pass the exam. Materials and equipment will be provided. The class will start at 8AM with registration and a continental breakfast; the workshop will begin promptly at 8:30AM, and end at 4:30PM. Lunch will be provided at noon.
Contractors (and their employees) who work in the Local Union 180 jurisdiction and contribute to the Trust may attend at no charge. Non-contributors may attend at $250 per person.

Change Order Reform (AB-1347) Legislation Moves Out of Assembly
|
NECA sponsored legislation to ensure contractors are provided a path to be paid timely for "change order" work, passed off of the Assembly floor last week with a 76-0 vote. Receiving bi-partisan support provides great momentum as the bill moves to the Senate for consideration. The opposition, which consists of almost all state and local agencies, will ramp up their efforts to defeat the bill in the second house. Much work remains to be done.
AB 1347 puts a process in place that requires agencies to respond to contractors' claim for payment in a timely manner, requires the agency to pay out portions of the work they acknowledge/agree is owed the contractor, and implements a fair process for resolving any disputed portions of a claim.

Public Works Contractor Registration Reminder
Deadline July 1st Annually

If you or your firm plans to bid California public works jobs, you must register with the Department of Industrial Relations (DIR) annually. The deadline to register or re-register is July, 1st of each year. Please note that many other service providers who are not technically "contractors" will also be covered by this requirement, as it applies to any company performing work on a public works project that is covered by prevailing wage. You will want to review all companies you normally work with on-site and make sure they know to register, if applicable.

Protection of Subsurface Installations
SB-119
|
SB-119 would make several changes to the "call before you dig" laws governing excavations near subsurface installations. This would include, among other things, prohibiting an excavator that damages a subsurface installation due to an inaccurate field mark by an operator, from being liable for damages provided the excavator complied with all pre-excavation notification requirements and procedures.
NECA is opposing this legislation, unless amended, because it would create the California Underground Facilities Safe Excavation Authority (CUFSEA). This authority would be comprised of nine members, seven of which would be appointed by the Governor, including: three utilities, one non-utility locator, one one-call center, and two CSLB appointees (contractors). The two remaining members would be appointed by the Speaker of the Assembly and the Senate Rules Committee. CUFSEA would be funded and authorized to enforce laws relating to the protection of underground infrastructure by hearing complaints and assessing civil penalties for violations of relevant laws.
Under this bill, a contractor who has had the misfortune of striking a subsurface installation, whether they were at fault or not, could face a multi-tiered process of enforcement by a number of different entities. This could include the new authority, coupled with existing jurisdictional agencies (CSLB, Cal OSHSA, local permitting agencies and District Attorneys) and the judicial process, all of which could have different and/or conflicting outcomes for contractors. NECA is also concerned about the effectiveness, fairness and transparency of this new authority over time.
This bill has been voted out of the Senate and will next be heard in a policy committee in the Assembly.

Improved Public Works Contractor Registration

The Department of Industrial Relations (DIR) has improved key features to the online Public Works Contractor Registration (PWCR) system. Contractors can now print out proof of registration filing, and verify the renewal or application is complete by running a search on the database of qualified public works contractors. A user guide with instructions has also been posted online.
Improvements to the PWCR system are part of the ongoing implementation of Senate Bill 854. SB 854, which became effective June 20, 2014, established a new public works program to replace the Compliance Monitoring Unit and Labor Compliance Program requirements for bond-funded and other public works projects. The new program covers all public works in the state rather than just selected categories of projects. The Labor Commissioner's Office continues to monitor and enforce prevailing wage requirements.
Contractors must register and meet requirements using the PWCR application before bidding on public works contracts in California. Using any Internet-connected computer, public works contractors can create an account, securely pay the $300 application or renewal fee and complete the application at their convenience. The registration process is finished when proof of payment is completed with the financial institution. If paying by credit card, the registration process is completed within 24 hours.
According to Labor Commissioner Julie Su, the online PWCR system, which was first launched nearly one year ago, has already helped to level the playing field for the public works community.
Among its wide-ranging enforcement responsibilities, the Labor Commissioner's Office inspects workplaces for wage and hour violations, adjudicates wage claims, enforces prevailing wage rates and apprenticeship standards in public works projects, investigates retaliation complaints, issues licenses and registrations for businesses and educates the public on labor laws. The most recent information related to California labor law is available on the Labor Commissioner's website as well as on Facebook and Twitter pages. "Wage Theft is a Crime," a multilingual campaign initiated statewide earlier this year, provides detail on how to identify and report wage theft, retaliation and other labor law violations.

Energy Legislation Heats Up
Details on Title IV Subtitles on Energy Efficiency

The Subcommittee on Energy and Power held a hearing on June 3, on the NECA-supported "Discussion Draft on Accountability and Department of Energy Perspectives on Title IV: Energy Efficiency." The hearing detailed the proposed Title IV Subtitles on Energy Efficiency and Accountability. The bill is designed to maximize the federal government's energy and cost savings and encourage the private sector's development and use of innovative energy efficient technologies. The bill would also bring greater transparency, fairness, and certainty to energy market participants. NECA's Look Ahead
The proposed legislation is beginning to gain momentum and Committee sources tell us they hope to move the bill out of Committee and through the House this summer. Meanwhile the Senate Energy Committee next week will hold a hearing to receive testimony on over 42 separate energy accountability and reform measures.
