Sales Tax Exemption For Fixed Price Contracts
Transactions & Use Tax Law
On April 1, 2015, a number of East Bay Cities increased their sales tax to raise additional revenue for city services. Hayward, San Leandro, Union City and El Cerrito are the first to reach the 10% threshold. Both Alameda County and El Cerrito received special legislative permission to seek voter approval to boost local sales tax 2.5 points above the 7.5 percent set by the state. Without permission, state law currently limits local governments from adding more than 2% to the state sales tax. Now, a bill in the legislature would increase the cap statewide to 3% thereby allowing every city in the state to ask their voters to increase the sales tax above 10%.
It was recently pointed out that on a million dollar "hard-money" project with roughly 40% in material costs, the difference of one half of one percent sales tax could be several thousand dollars.
Please remember that there is a general fixed price contract exemption contained in the Transactions and Use Tax Law for purposes of exempting all fixed price contracts from the various city and county tax rate increases when those contracts are entered into prior to the operative date of those rate increases (see Revenue and Taxation Code Sections 7261(g) and 7262(f)).
If you have lump-sum jobs in any of the areas listed above as well as Richmond, Pinole, Albany, and Union City, be sure to see if your circumstances qualify for the exemption. You should also keep this on your radar going forward, especially if the cap is increased. (Taken from Contra Costa NECA Newsletter, April 2015.)

Spring General Member Meeting Last Week
Affiliate Members Showcase Products & Services
Last week's Spring General Member meeting was a big success with over 60 in attendance. The evening started with networking, good conversation, and dinner. Our focus this year was our affiliate members, who were present to display their product and speak to our contractor attendees about partnership opportunities. Our Chapter President Kurt Brinkman and Executive Director Greg Armstrong welcomed everyone and turned the floor over to our affiliates to give a brief talk about themselves and their product/services.
Greg Long, Long Electric and Chair of Electri International spoke about the recently released Electri publication on Change Orders. He urged everyone to use the publication when bidding projects. Darlene Besst talked briefly about our Day at the Capitol and pending change order legislation, AB-1347. She encouraged those in attendance to take the opportunity to join us on April 22nd to urge support of the legislation as well as discuss with legislators how the absence of legislation has affected their business.
The evening concluded with a raffle prize drawing of gifts donated by our affiliates, and NECA. Our next general membership meeting will take place in September, so mark your calendars and plan to join us.

California Legislation - AB 2312
Stop Metal Theft
Special thanks to our affiliate member Sims Metal Management for bringing to our attention AB 2312, legislation that mandates California scrap dealers to sign up for alerts from the Scrap Recycling Industry in an effort to help stop metal theft. Law enforcement is also encouraged to report recycled metal thefts such as copper, brass, aluminum, nickel and stainless steel to name a few.
The scrap recycling industry is working to be a part of the solution to material theft. ScrapTheftAlert.com is a FREE tool for law enforcement and the industry, and is also available to the public. It allows for individuals to alert the scrap industry of crucial thefts of materials in the United States and Canada. Upon validation and review, alerts are broadcast by email to all subscribed users within a 100-mile radius of where the incident occurred. Please view the user guide on how to use the website.
