Meeting Held with the City of San Leandro  

Discussions About Citywide PLA    

 

Last week, NECA, the sheet metal workers association (SMACNA) and three of their contractors joined together in a meeting with the San Leandro City Manager. San Leandro is in discussions with the Trades on a citywide PLA. Representing NECA contractors were San Leandro contractors Mike Boehmer with H.A. Bowen Electric, Kim Scruggs with Columbia Electric, and Darlene Besst. The purpose of our meeting was to communicate with the City how contractors benefit from a PLA, including a level playing field when bidding, the advantages of contracting with local businesses and local hire, apprenticeship and continuing education training for journey level workers, career technical opportunities, safety, and more. The contractors present took the opportunity to talk to the City Manager about their businesses successes and challenges. The City Manager expressed his appreciation for the meeting and encouraged those present to attend the City Council meeting on February 10th where City staff with present their findings and recommendations to the Mayor and City Council.

 

Nationwide Business Development Meeting   

At the Electrical Training Institute  

 

NECA, IBEW, and LMCC Business Development Professionals just capped its 3rd annual business development conference at the Electrical Training Institute in Los Angeles. The conference continues to grow and this year attracted more than 40 attendees who gathered together to network and share best practices in an effort to grow market share. The forum also provides an educational component, which included new information about NECA's ECAP platform and PACE financing, and how various areas are using this tool in their business development efforts. Caitlin Gross, Manager of Business Development for NECA said it well: "Some of us have greater expertise in energy and new markets, some in policy, some in marketing. We all have a common goal, and we recognize that we're stronger when we put our heads together."  

 

The conference opened with remarks from Los Angeles NECA Chapter Manager, Jim Willson. Jim discussed plans for upgrading the Electrical Training Institute to a "net zero energy plus" facility. It all started with our Zero Net Energy Center in San Leandro, and we're excited to see that other IBEW/NECA training facilities are jumping on board. Attendees toured the expansive training center's upgrades and discussed how the facility can be used as an effective business development tool.  

 

Darlene Besst had an opportunity to share how we are using our Zero Net Energy Center as a business development tool. PDE (a Northern California Chapter and Los Angeles Chapter member) President Dan Henrich, and Vice President Dan Cohee joined the conference to provide a presentation and a tour of the microgrid on site. Dan made an interesting comment that we think all contractors can use. He affirmed that through his NECA membership his company is a part of the "largest electrical contractor in the world." The second day of the conference began with a national business development update and plans for 2015. The conference concluded with all attendees given the floor to share a summary of their local efforts.

 

American SubContractors Association Expo

The Bay Area Chapter of the American Subcontractors Association General Contractor Expo is tomorrow.... January 27th. Seventy-five people are registered to attend, including several general contractors and our Chapter members. It's not too late for last minute registration. Don't miss AGC of America Chief Economist Ken Simonson's address on economic news relevant to the construction industry, followed by an excellent networking opportunity. Leadership & Professional Development Conference


NECA NOW Executive Leadership Conference is April 13-16th in Miami, Florida. This is an unique conference for NECA Members dedicated to professional and personal growth. Along with networking and social events, the format of the conference is to bring forward ideas to make your business more successful. The sessions will focus on market development, leadership, operations, risk management, financing and personal development. Learn from top business experts, such as plenary speakers Steve Wiley with The Lincoln Leadership Institute and Scott Klososky of Future Point of View. Plus, there will be social activities including the Networking Reception, Golf Tournament and our Chapter Dinner. Keep These Important Matters in Mind for 2015 

New Laws, Facts & Reminders for Contractors Employers, & Business Owners  


Contractors:

  • Public works contractors and subcontractors have until March 1, 2015, to register through the California Department of Industrial Relations ("DIR") to bid and enter into public works contracts on state and local public works projects. Unregistered contractors and subcontractors may not be listed in a bid after March 1, 2015, and may not work on a public works project after April 1, 2015.
  • Additionally, with a few exceptions, public works contractors and subcontractors will be required to electronically submit certified payroll records via a new DIR certified payroll form on all public works projects awarded after April 1, 2015.
  • As of July 1, 2015, contractors bidding on public works projects must include the license number of all subcontractors listed in their bid. The failure of a bidder to provide the license number in a subcontractor listing submitted with its bid will render the bid non-responsive.

Employers:

 

California employers are now required to provide their employees with up to three days of paid sick leave each year. The new law applies to both full-time and part-time workers at businesses of all sizes - public and private, for profit and non-profit. Effective July 1, 2015, employees who work in California for 30 or more days within a year from the date of hire (with a few exceptions) can accrue one hour of paid sick leave for every 30 hours worked subject to an employer's ability to cap the accrual of paid sick leave at six days and the use of such leave to three days per year. The new law also contains certain posting, disclosure and record-keeping requirements. Although the law does not go into effect until July 1, 2015, a new sick leave poster and revised Notice to Employee must be used by employers as of January 1, 2015. Employers are encouraged to review and update their employment policies and handbooks to comply with the new law, and consult with legal counsel regarding any questions about its administration.

 

Several Bay Area cities have also passed ordinances requiring a higher minimum hourly wage effective January 1, 2015. Some of these cities include: San Jose ($10.30), Sunnyvale ($10.30) and San Francisco ($11.05).

 

Business Owners With Public Accommodations:

 

Is your business compliant with requisite state and federal (ADA) accessibility standards? ADA litigation is expensive and time consuming, and investigating and remediating non-compliant features is the best way to minimize your exposure to costly lawsuits. Contrary to common misconception, most businesses-even those that have been in existence for many years-are required to be accessible. Although it is impossible to entirely insulate your business from liability or a lawsuit, you can minimize those risks by assessing your business for accessibility barriers (including inspection by a Certified Access Specialist) and promptly remediate any areas of non-compliance. Property owners and tenants can also allocate responsibility among themselves by contract for maintenance and correction of any non-conforming features - as well as the defense and indemnity for damages resulting from an accessibility lawsuit. Indeed, a commercial property owner or lessor must state in every lease or rental agreement executed on or after July 1, 2013, whether the property being leased or rented has undergone inspection by a Certified Access Specialist (CAS) and, if so, whether the property has or has not been determined to meet all applicable construction-related accessibility standards pursuant to California Civil Code Section 55.53. Business owners should consult with legal counsel regarding any questions about their business' accessibility or questions about their leases.

IBEW 595 Health & Welfare / Pension Benefits Fair

February 7, 2015  

 

The Local 595 annual Health & Welfare and Pension Benefits Fair will be held on Saturday, February 7. 2015, 9AM until 12PM, at the Alameda County ZNE Center in San Leandro. Service providers to the trust funds will be there to help inform and educate, including Kaiser, PacifiCare, United Healthcare Medical & Dental, Delta Dental, plan administrator staff, Local 595 staff, Office Employees Federal Credit Union and Dodge & Cox. This event promises not only to be informative but fun too, with many great door prizes and giveaways. Registration is not required.

Mechanics Lein Law - Thursday, February 12, 2015, from 9:00AM - 12:00PM, at the Chapter Office. The cost is $200.00 for NorCal NECA members, $300.00 non-members.  Don't forget, 2015 Education Funds can be used.
