NECA Contractor Call to Action
AB1705 (Williams) & SB785 (Wolk)
We are proud to announce that our NECA sponsored "Retention Reform" bill, AB 1705 has made it through the legislative process and now awaits action by Governor Brown. This measure will close a loophole regarding the use of the "substantially complex" exemption to the 5% retention cap on all public works projects. In addition, the measure extends the sunset for the 5% retention mandate until 2018. Local governments and school districts have stepped up their opposition to the measure and we need letters of support from our contractors.
SB 785 (Wolk) would consolidate and standardize the authorizing statutes for public works design-build construction. The NECA supported legislation includes a "skilled and trained workforce" requirement. The bill specifies that "a design-build entity shall not be prequalified or shortlisted unless the entity provides an enforceable commitment to the local agency that the entity and its subcontractors at every tier will use a skilled and trained workforce to perform all work on the project or contract that falls within an apprenticable occupation." Some public agencies are lobbying against the measure saying that this requirement will limit the number of contractors who bid on design-build projects in rural areas. We need your help to assure bill author Senator Wolk and the Governor that this is simply not true.

Golf Proceeds
Delivered to Four Deserving Charities
Each year our annual Golf Tournament generates enough revenue to cover expenses and donate to various charities within our Chapter's jurisdiction. Over the last few weeks, NECA and our contractors visited the charities selected by our contractors. We were honored to deliver gifts of $5,000 each to these charities, pictured from left to right: The Attitudinal Healing Connection (not pictured below); Aldea (Wolfe Center); Modesto Gospel Mission; and Hospice of San Joaquin County and once again this year, we made a donation to the Greater Bay Area Make-A-Wish Foundation.
Checks were presented to these very deserving charities by Kurt Brinkman, Ruben Perez, Brian Gini, Lew Frain, and Darlene Besst. We were able to tour the facilities and learn more about how these programs serve the people in their respective areas. Each person we met with expressed gratitude for being chosen to receive our gift, and asked us to convey to all of those responsible a sincere thank you! We could not have done this without the support of all of our contractors, and for that we are very grateful. Please take a moment to visit the web sites to learn more about these organizations.

Statewide LMCC Retreat
Wedneday & Thursday, September 17-18
Plan to attend for an update on Statewide LMCC activities on September 17th, followed by a meeting/visit/tour at the California Lighting Technology Center. A detailed agenda and details of the CLTC visit will be provided next week for those interested. See the attached information sheet.

Business Academy for Regulatory Compliance
The greater Stockton Chamber of Commerce and the California EPA collaboration held a seminar last week to inform local businesses about the regulatory program & environmental laws in Stockton.Senior Hazardous Substances Scientist Alan Ito reviewed the federal, state & local laws and enforcement options for environmental & regulatory programs in California and greater San Joaquin area. In addition, Kasey Foley, program coordinator for the San Joaquin environmental health department spoke about the Certified Unified Program Agency (CUPA) free hazardous waste classes for small business owners. AGC Bay Region Annual Public Works Night
The AGC will hold its annual Public Works Night event on Wednesday, September 10th. This annual premier event bring together public and private owners, contractors, project managers and construction-related professionals to network and get a preview of the public and private works projects about to hit the streets. San Joaquin WIB
San Joaquin WIB Apprenticeship Committee: The committee met on August 20th to finalize a Memorandum of Understanding (MOU) between the SJ WIB and the Northern California Apprenticeship Training Coordinators. Representatives from NECA, DAS, SJ-WIB, local training directors, and Delta College constitute the committee. The MOU outlines the cooperation between the local Workforce Investment Board and the Department of Industrial Relations (DIR), and Division of Apprenticeship Standards (DAS) in compliance with the implementation of AB 554. AB554 was passed into law requiring local boards to ensure that programs and services funded by the Workforce Investment Act (WIA) are conducted in coordination with one or more apprenticeship programs approved by the DIR.

Northern California Facilities Expo
Reminder... the Northern California Facilities Expo is coming soon to the Santa Clara Convention Center starting on September 24th. Click here for details. On September 24th, 9:35 AM to 10:35 AM, Byron Benton and the Zero Net Energy Center team will conduct a seminar on "Retrofitting a Building for Zero Net Energy - the ZNE Center's Success Story." In addition, NECA and IBEW will participate with a booth on the expo floor. Contractors are encouraged to join us at our booth with your marketing materials for an opportunity to meet one-on-one with facilities decision-makers and let them hear from you current industry trends and energy efficiency upgrades to help them save money. Classes & Workshops
At the Chapter Office in Dublin
Construction Law Class, Wednesday October 1st, presented by Dan McLennon, McLennon Law Corp. Conditioning your bid can be a powerful tool for negotiating and securing your preferred contract terms and conditions. During this session you will receive suggested bid condition language and tips on how to negotiate using them. The cost is $100 for NorCal NECA members and $200 for non members. Education fund credits may be used.
