QUESTION 1: 

When will the new NPDES permits be issued?"

 

ANSWER 1: 

Probably after August 1, 2013.  Existing projects will continue to operate under their existing permit, while new projects of 1-acre or greater of land disturbance will have to wait until the new permits are issued (ya right!). The stakeholders meetings with the Georgia EPD are now complete and the draft 2013 permits are in for final review by the "powers at be".  Once, the permits are approved final, this newsletter will highlight the changes for your viewing pleasure.

Who is qualified to perform the 7-day inspection for the installation of 1st phase BMPs on NPDES General permitted construction sites?" 

 

ANSWER 2: 

In the GAR100003 permit (the answer is the same for all three permits), pages 19-20 state that EPD must be notified in writing and also must give approval (in writing) of an alternative person who would be responsible for providing the BMP inspection indicating that 1st phase BMPs were properly installed as per the approved design.

QUESTION 3:

Why hasn't EPA issued their new Stormwater Rule?  They're already over the June deadline!  NPDES Training Institute received a response from the EPA that says it will not be out until February, 2014.

Environmental groups contend that the rule is the most important thing the current administration can do to boost green infrastructure, which uses marshes, trees and rain gardens to soak up water and filter pollution rather than more expensive concrete structures that channel it directly to a waterbody.

But industry says the rule stands to be one of the most expensive ever promulgated by EPA, with the potential to chill development across the country. The agency has not made public any cost estimates, but industry and municipal officials say stormwater fixes often come with a bill that ranges into the hundreds of thousands of dollars per site.  Businesses are worried about how EPA will deal with the regional and site-specific differences that play a key role in how much stormwater runoff leaves a property.

Langdale Mill Dam

Langdale dam was built in 1908 to supply water to the adjacent Langdale Mill of West Point Pepperel (formerly Langdale Mills), and is now owned and operated by Georgia Power. It produces an average of 1 megawatt of hydroelectric power.  The river here lies entirely on the Georgia side of the state line, but the dam itself enters into Alabama territory.
 
Langdale Mill was built 1866, in the City of Valley, Alabama.  The mill originally made lap blankets and later became key manufacturer of Cotton Duck ship sail materials. It is known for making sails for Ole Ironsides. The Mill had been slated for demolition but, in 2004, the city developed plans to convert the property into housing, retail stores, a dinner theater, an environmental learning center, and farmers' market.  Valley is a founding member of the Southern Textile Heritage Corridor, a 700-mile heritage pathway running from Richmond, Virginia, to Montgomery, Alabama.

REMEMBERING THE SUPREME COURT SACKETT DECISION

Sacketts v. epa
If you remember, just over a year ago, the U.S. Supreme Courtdecided Sackett v. EPA, struck down the ban on "pre-enforcement review" of EPA orders issued under the Clean Water Act ("CWA"). In other words, the Supreme Court held that nothing in the CWA impliedly bars a party from filing suit against the EPA to challenge such an order before the government initiates a judicial enforcement action. GOOD NEWS, RIGHT?!  Well, since the case was decided, six lower federal courts have applied Sackett. What one finds from reviewing these early cases is that:
  • They are fact-specific;
  • They are not limited to the CWA;
  • They turn on the court's finding of whether the action challenged was "final"; and
  • Whether the agency action is deemed final turns on whether the court sees it "just a step in the deliberative process" or as leaving nothing left to do but to refer the case to a government lawyer to enforce.

MIAMI-DADE AGREE TO $1.6 BILLION UPGRADE TO ELIMINATE 
SEWAGE OVERFLOWS
 

Between January 2007 and

May 2013, Miami-Dade reported 211sanitary sewer overflows totaling more than 51 million gallons. Such overflows included a number of large volume overflows from ruptured force mains. At least 84 overflows, totaling over 29 million gallons of raw sewage, reached navigable waters of the United States. Miami-Dade's Central District wastewater treatment plant (WWTP) also experienced several violations of the effluent limits contained in its NPDES permit. 
Miami-Dade estimates it will spend approximately $1.6 billion to complete the upgrades required by the consent decree and come into compliance with the Clean Water Act. Under the settlement, Miami-Dade will also pay a civil penalty of $978,100 ($511,800 to be paid to the United States and $466,300 to FDEP) and complete a supplemental environmental project costing $2,047,200.
