Health experts say 2012 is on track to be the worst year ever for west nile virus, the Centers for Disease Control reports new cases jumped 25% over the last week with nearly 2,000 cases nationwide and almost 90 deaths. Two people died in North Carolina with west nile, and three in Georgia.
With the new information out from health officials in New York are talking about regulations that would require larvicide in certain municipal stormwater systems.

WHAT HAPPENS IF YOU BUILD.....
QUESTION: on a remaining undeveloped lot(s) to construct a single-family residence less than 1 Acre?
ANSWER: A LDA permit fee ($40 per disturbed acre) and NPDES permit fee ($40 per disturbed acre) are required. State Buffer Variance rules apply. The permittee can be the homeowner or the contractor.

QUESTION: build a screen porch on an existing slab/foundation within Georgia state-mandated buffers?
ANSWER: Land-disturbing activities are not taking place therefore, LDA permit and NPDES permits are not required. A buffer variance would not be required if the buffer is not disturbed. If grading/construction equipment is used around structure within the buffer, the contractor must use matting and can not disturb the soil.

QUESTION: an addition onto an existing single-family residence less than 1 Acre?
ANSWER: LDA permit and NPDES permit are not required because the existing lot has already been developed, therefore, a tertiary permit would not be applicable. A ES&PC Plan is required.

Georgia EPD Issues Waste Water Discharge Permit to King America Finishing Company
EPD discovered an unpermitted wastewater discharge from the King America Finishing facility in Screven County during an investigation into a major fish kill on the Ogeechee River in May 2011. As a result of the unpermitted discharge, EPD and King America Finishing reached a settlement in which the company agreed to spend $1 million on supplemental environmental projects to benefit the Ogeechee River.

Scotts Miracle-Gro
Will Pay $12.5 Million in Criminal Fines and Civil Penalties for Violations of Federal Pesticide Laws
The Scotts Miracle-Gro Company, a producer of pesticides for commercial and consumer lawn and garden uses, was sentenced today in federal district court in Columbus, Ohio, to pay a $4 million fine and perform community service for eleven criminal violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), which governs the manufacture, distribution, and sale of pesticides. Scotts pleaded guilty in February 2012 to illegally applying insecticides to its wild bird food products that are toxic to birds, falsifying pesticide registration documents, distributing pesticides with misleading and unapproved labels, and distributing unregistered pesticides. This is the largest criminal penalty under FIFRA to date.

RACETRACK TO PAY $1.25 MILLION for CLEAN WATER ACT VIOLATIONS
U.S. Environmental Protection Agency (EPA) and the U.S. Department of Justice announced that Sterling Suffolk Racecourse LLC will pay a civil penalty of $1.25 million to resolve violations of the Clean Water Act (CWA). The company is also spending more than $3 million to prevent polluted water from entering nearby waterways and will perform three environmental projects worth approximately $742,000 that will provide water quality monitoring and protection efforts for more than 123 square miles of watershed. The terms of the settlement are contained in a consent decree lodged in federal court in Boston today.

As Americans, we cannot take our eyes off of the importance of water quality. Respecting our neighbors downstream is what the Clean Water Act is all about!
