WEST NILE VIRUS ON THE RISE!

MosquitoHealth experts say 2012 is on track to be the worst year ever for west nile virus, the Centers for Disease Control reports new cases jumped 25% West Nile VIrus over the last week with nearly 2,000 cases nationwide and almost 90 deaths. Two people died in North Carolina with west nile, and three in Georgia

With the new information out from health officials in New York are talking about regulations that would require larvicide in certain municipal stormwater systems.

 WHAT HAPPENS IF YOU BUILD.....

 

Tertiary lot plan QUESTION: on a remaining undeveloped lot(s) to construct a single-family residence less than 1 Acre?

 

ANSWER: A LDA permit fee ($40 per disturbed acre) and NPDES permit fee ($40 per disturbed acre) are required. State Buffer Variance rules apply. The permittee can be the homeowner or the contractor.

QUESTION: build a screen porch on an existing slab/foundation within Georgia state-mandated buffers?

 

ANSWER: Land-disturbing activities are not taking place therefore, LDA permit and NPDES permits are not required A buffer variance would not be required if the buffer is not disturbed. If grading/construction equipment is used around Slab near bufferstructure within the buffer, the contractor must use matting and can not disturb the soil.

 QUESTION: an addition onto an existing single-family residence less than 1 Acre?

 

ANSWER: LDA permit and NPDES permit are not required because the existing lot has already been developed, therefore, a tertiary permit would not be applicable. A ES&PC Plan is required.

 OGEECHEE RIVER Georgia EPD Issues Waste Water Discharge Permit to King America Finishing Company

EPD discovered an unpermitted wastewater discharge from the King America Finishing facility in Screven County during an investigation into a major fish kill on the Ogeechee River in May 2011. As a result of the unpermitted discharge, EPD and King America Finishing reached a settlement in which the company agreed to spend $1 million on supplemental environmental projects to benefit the Ogeechee River.

Scotts Miracle-Gro

Will Pay $12.5 Million in Criminal Fines and Civil Penalties for Violations of Federal Pesticide Laws

Scotts Miracle Gro 

The Scotts Miracle-Gro Company, a producer of pesticides for commercial and consumer lawn and garden uses, was sentenced today in federal district court in Columbus, Ohio, to pay a $4 million fine and perform community service for eleven criminal violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), which governs the manufacture, distribution, and sale of pesticides. Scotts pleaded guilty in February 2012 to illegally applying insecticides to its wild bird food products that are toxic to birds, falsifying pesticide registration documents, distributing pesticides with misleading and unapproved labels, and distributing unregistered pesticides. This is the largest criminal penalty under FIFRA to date.

RACETRACK TO PAY $1.25 MILLION for CLEAN WATER ACT VIOLATIONS

 

Suffolk Downs Racetrack FIne U.S. Environmental Protection Agency (EPA) and the U.S. Department of Justice announced that Sterling Suffolk Racecourse LLC will pay a civil penalty of $1.25 million to resolve violations of the Clean Water Act (CWA). The company is also spending more than $3 million to prevent polluted water from entering nearby waterways and will perform three environmental projects worth approximately $742,000 that will provide water quality monitoring and protection efforts for more than 123 square miles of watershed. The terms of the settlement are contained in a consent decree lodged in federal court in Boston today.

Requirement(s) of Order: Immediately stop all land disturbing activity except installation and maintenance of E&S controls; properly install/maintain all necessary E&S controls on site; submit approvable Stream Restoration Plan/schedule that will ensure effective removal of all sediment discharged to state waters associated with site; also include restoration of affected stream habitat to pre-discharge conditions; site will be completely stabilized by March 31, 2013; stipulated penalties if not completed by date

GDOT's James Magnus - NPDES MS4 Permit 

On December 15, 2011 the Georgia Environmental Protection Division (EPD) issued NPDES Permit No. GAR041000 to the Georgia Department of Transportation (GDOT) for storm water discharges from its municipal separate storm sewer system (MS4) to waters of the State.

This first-time permit requires GDOT to reduce pollutants in storm water through six minimum control measures: Public Education and Outreach, Public Involvement/Participation, Illicit Discharge Detection and Elimination, Construction Site Storm Water Control, Post-Construction Storm Water Management, and Pollution Prevention/Good Housekeeping.  The permit covers GDOT roadway drainage, bridges, detention ponds, etc. in 145 urban areas around the State.

You may wonder, "What is a Municipal Separate Storm Sewer System (MS4)?" A MS4 is a conveyance, or a system of conveyances, that is owned by a state, city, town, village, military base, or other public entity (e.g., University) that discharges stormwater to waters of the United States. A MS4 collects or conveys stormwater (including storm drains, pipes, ditches, etc.). It is not a combined sewer system, and it is not part of a publicly owned treatment works (POTW). MS4s must report annually to the State administering the MS4 permit or the US EPA, and that's where we can help! Call us at 678-469-5120 and ask for Luke.

It's important that we sacrifice a little to give our future generations an equally great place to work, live, fish, hunt, and enjoy.  As construction picks back up, let's remember the importance of having a healthy economy; a strong construction sector that is mindful of stormwater runoff impacts to America's  watersheds.
Before the Clean Water Act was passed, sediment, sewage, and chemicals caused America's rivers, like the Chattahoochee River, to be void of fish. As Americans, we cannot take our eyes off of the importance of water quality. Respecting our neighbors downstream is what the Clean Water Act is all about!
