To prevent theft of their intellectual property assets, software companies are smart to file for various intellectual property (IP) protections. Filing timely patent, copyright and trademark claims with the US Patent and Trademark Office (USPTO) reduces the risk of theft of a company's intellectual property.  What is timely? For example, seasoned IP lawyers usually advise their clients to file an "intent to use" trademark application before the client launches its product or service in commerce. After use in commerce commences, a statement of use can be filed with the USPTO to update the filing.  Once a claim is allowed, the USPTO will publish the claim.  If publication results in no opposition, certification is usually assured.  To maintain the protection of the IP portfolio, claims must be renewed after several years.

Well before a company rolls out a software product in the marketplace, the company should engage a firm like Jeffrey G. Nutt & Associates to prepare a Software Licensing Agreement.  A properly worded software license lays down the lines of accountability for users who purchase the product or purchase access to the product.  The agreement will permit the legal and proper use of the product and reduce the risk of unauthorized use of, or aftermarket sale of, the product. 

Users or prospective users are well advised to read license agreements and not blindly agree to all terms.  Reading the actual terms helps to alert the user to whether acceptance can expose the user to computer security risks (ie: Trojan horse viruses) or to privacy risks.  These risks can occur when the agreement requires the user to permit a third party to collect private or proprietary information about the user's internet activity as a condition for the software's use.  If you or your business need a software license agreement or have a question about a user agreement, please contact Jeffrey G. Recognizing the value of the Fulbright scholarship program in my own life and others, I recently introduced Michigan and National Fulbright Scholars with one another and key stakeholders.

In September of this year, I had the distinct honor to meet and personally thank Harriet Fulbright, founder/president of Harriet Fulbright College and widow of the late Senator William J. Fulbright who launched the Fulbright scholarship program that became the flagship international exchange program of the United States. I completed my Fulbright Scholarship at St. Edmund Hall, Oxford University in 1986. I was one of six American Fulbright scholars at Oxford during the academic year.

Statewide, I recently had the honor to address incoming Fulbright Scholars and students at the Michigan welcome reception at the University of Michigan, Ann Arbor, on October 1, 2012.

Nancy Scarlet Gives Oakland County an Oakfit Edge     

 

One University of the Americas Fund leaders welcomed Nancy Scarlet to its most recent "Fridays at 4 Leadership Meeting," just before our nation's annual Veteran's Day celebrations.  Ms. Scarlet is the Director of Human Resources for Oakland County, Michigan and the spokesperson for the Oakfit program.  The Oakfit program is a wellness program that reduces costs for the county called home to more than 1,200,000 residents.  Oakfit serves approximately 3,200 county employees.  The program offers weight watchers, pedometers, walking paths, Pilates exercise classes, health screenings with biometrics, and laser-or non-laser smoking session opportunities.  In Ms. Scarlet's words, "Oakfit shows participants that we care.  It changes lives forever."  In 1996, she attended the Atlanta Olympic Games.  Did you know that Detroit bid eight consecutive times on the Olympics from the late 1940's to 1968?  

 

When asked whether regional Detroit should again bid on the Olympics, Ms. Scarlet answered, "Why not?"  One University of the Americas Fund seeks to participate in the formation of a new school with a fitness twist, to be known as United University of America.  The vision for the Veteran-friendly effort is at www.UnitedUniversity.org.
