Workplace Injury: Clumsy or Compensable?
The mere fact that an individual suffers some sort of injury while at his place of employment is not sufficient to render the injury compensable. The two parts of the phrase "arising out of and in the course of employment" are not synonymous. Also, both parts must exist simultaneously before a court will allow recovery. Read More

BP Oil Spill Settlement Excludes Injured Cleanup Workers
More than 95 percent of the workers injured cleaning up the BP oil spill are in legal limbo. If the workers want money for their physical injuries, they'll need to sue the company, a federal judge in New Orleans has ruled. Read More

The Florida Supreme Court issued a unanimous decision Thursday, December 4, in Leticia Morales v. Zenith Insurance Company, upholding the workers' compensation system as the exclusive remedy for injured parties. Read More
