Using the 'Willful Misrepresentation' Defense in NC Work Comp Cases
In defending a workers' compensation claim, it may be discovered that the injured employee had not been forthcoming about previous injuries or work restrictions. For a "willful misrepresentation" defense to be applicable, an employee must provide the false information at one of three points in the hiring process. Read More
Family Will Not Collect $2.4 Million for Worker's Death

The family of a Florida construction worker who was killed by a 1-ton falling steel column cannot collect a $2.4 million judgment from his employer. The state appeals court said that the accident did not meet the standard that his injury was "virtually certain." Read More

Oregon Releases National Study on Workers' Compensation Rates
Oregon has released its biennial study on workers' compensation rates in all the states and D.C. The 2014 results: California came in at Number 1 with the highest rates, followed by Connecticut and New Jersey. North Dakota had the lowest rates, again. Read More
