Changes at East Cliff Village: Have Your Say

The East Cliff Village Shopping Center was once a vibrant shopping center meeting a broad set of needs in the Live Oak community. With the increase in development on 41st Avenue in Capitola, East Cliff Village Shopping Center has gone through a long period of decline. In conversations with literally hundreds of people in the community, there has been a constant refrain asking why the East Cliff Village Shopping Center has not been redeveloped. Over the years, plans have been introduced that have been roundly criticized and then dropped by developers. Now there are some changes underway that provide an opportunity for the community to weigh in on future development of the center.
I invite the community to sit down and hear about changes underway and possibilities for the future on Monday, April 29, 2013, at 7 p.m. at Simpkins Swim Center (979 17th Avenue). A new family health clinic will be opening on the site next year (run by the Santa Cruz Women's Health Center) and there may be some new construction on the old Polivio's site. My hope is that at the April 29 meeting, and at a follow-up meeting in May, the community can offer input on design standards to help guide future development of the site. While the economy will play a significant factor in how quickly changes are made, having your input will ensure that the community's interests regarding the height of structures, the layout of buildings, and the size of buildings close to the street will be included in consideration of future development. This meeting will provide an opportunity for community members to voice their needs and visions for East Cliff Village Shopping Center and will give ideas to the property owner to pursue new development as the economy recovers.
More information will be provided at the meeting on April 29 and I urge interested residents to come and have your say concerning the East Cliff Village Shopping Center that serves the Live Oak community.

Protecting Mobile/Manufactured Home Residents
 Within the last two years, the County successfully fought a forced conversion attempt of the rent-controlled housing stock at Alimur Mobile Home Park in Soquel. In that instance, the owner of the park attempted to convert the park from a rental park to an ownership park, thereby exempting the park from local rent control requirements. Although the park owner promised that the new spaces would be reasonably priced, there was a healthy amount of skepticism from park residents. When residents were asked to vote on their preference, the vote was overwhelmingly against conversion (119-2). Despite these results, the owner attempted to convert the park anyway.
Our Board honored the residents' wishes and as a result was the target of a multi-million dollar lawsuit. With effective representation from our County Counsel's Office, we were successful in defending the lawsuit and the ruling set a precedent for consideration of a resident survey when determining the merits of a proposed conversion.
Unfortunately, some park owners have confused residents in their surveys about conversion. They have offered multiple choices in surveys using deceptive wording, causing some park residents not to participate in the survey. In subsequent litigation, some Southern California courts have allowed survey votes to be considered where only 5% of park residents voted. In those cases, there was still a majority of residents who voted against conversion, but the judges allowed the conversions to take place anyway; they said that not enough people participated and equated lack of participation with affirmative support of the conversion request.
Senator Hannah-Beth Jackson has introduced Senate Bill (SB 510) which seeks to clarify the rules for resident surveys. This bill delivers the power back to local elected bodies to determine the outcome of the surveys and whether enough people have participated. If approved, SB 510 would restore balance and fairness, reduce litigation against local governments, help protect vulnerable mobile home park residents, and ensure that park owners deal fairly with homeowners to gain support for a conversion.
Currently the manufactured home park condominium conversion process is not effective or fair, nor does it adequately protect park residents. We have seen the results of the lack of clarity in the law and we have paid to defend our local residents. I have asked our Board to support SB 510 because it makes necessary changes to protect park residents and local governments around the issue of park conversions. Back on Stage
Once apparently was not enough! A new Bob Dylan tribute show is taking place in Santa Cruz at the Kuumbwa on April 19th at 8pm. There will be a great band with many wonderful performers playing the music of our favorite songwriter. After my triumphant performance in January they have asked me to perform (one song) again. It will be different than last time. So please come and enjoy a great night of music and see if I manage to pull it off once again. This will be a completely new show.
