N.C. emergency gun ban struck
A federal district court judge in North Carolina has struck down that state's emergency power to impose a ban on firearms and ammunition outside the home during a declared emergency, ruling that the provision violates the Second Amendment right to keep and bear arms.
The case, Bateman v. Purdue, was brought by the Second Amendment Foundation, Grass Roots North Carolina FFE and three individual plaintiffs. Defendants in the case were Gov. Beverly Purdue and Reuben F. Young, secretary of the state's Department of Crime Control and Public Safety, in their official capacities.
In his opinion, Judge Malcolm J. Howard, senior United States district judge for the Eastern District of North Carolina, wrote, "...the court finds that the statutes at issue here are subject to strict scrutiny...While the bans imposed pursuant to these statutes may be limited in duration, it cannot be overlooked that the statutes strip peaceable, law abiding citizens of the right to arm themselves in defense of hearth and home, striking at the very core of the Second Amendment."
"When SAF attorney Alan Gura won the Heller case at the Supreme Court," noted SAF Executive Vice President Alan M. Gottlieb, "the gun ban crowd said that we were a 'one-trick-pony' and that we would never knock out another gun law. Well, SAF has now knocked out gun laws in Maryland, Illinois and North Carolina.
"We filed this lawsuit on the day we won the McDonald case against Chicago," he added, "extending the Second Amendment to all 50 states. This was part of our strategy of winning firearms freedoms one lawsuit at a time."
Gottlieb pointed to language in Judge Howard's ruling that solidifies the Second Amendment's reach outside the home. The judge noted that the Supreme Court in Heller noted that the right to keep and bear arms "was valued not only for preserving the militia, but 'more important(ly) for self-defense and hunting."
"Therefore," Judge Malcolm wrote, "the Second Amendment right to keep and bear arms 'is not strictly limited to the home environment but extends in some form to wherever those activities or needs occur."
"Under the laws at issue here, citizens are prohibited from engaging, outside their home, in any activities secured by the Second Amendment," Judge Malcolm wrote. They may not carry defensive weapons outside the home, hunt or engage in firearm related sporting activities. Additionally, although the statutes do not directly regulate the possession of firearms within the home, they effectively prohibit law abiding citizens from purchasing and transporting to their homes firearms and ammunition needed for self-defense. Right to hunt & fish laws
Right to Hunt and Fish Constitutional Amendments will be on the ballot in Idaho, Nebraska and Kentucky this November. The Kentucky Legislature passed an Amendment last year. The NRA has led efforts to provide the constitutional protections by preserving science-driven wildlife management and the North American Wildlife Conservation Model. The amendments offer specific defenses against efforts to incrementally destroy our hunting heritage by anti-hunting extremist organizations such as The Humane Society of the United States and People for the Ethical Treatment of Animals. Nearly one-quarter of all states have adopted similar amendments. "Hunting, fishing, and harvesting of wildlife are part of the American fabric," said Chris Cox, executive director for NRA's Institute for Legislative Action. "These constitutional amendments are a concerted effort by the NRA to help preserve America's rich hunting heritage that is increasingly under attack by well-organized and well-funded anti-hunting radicals. The stakes have never been higher. Voters in Idaho, Nebraska and Kentucky must go to the polls and vote to support our outdoor heritage. Ohio moves to simplify concealed carry
Ohio Representative Terry Johnson (R-McDermott) has introduced HB495, a bill designed to reform Ohio concealed carry law to protect the rights of law-abiding gun owners and continue a trend toward making Ohio law similar to other states. Current Ohio gun laws contain a number of ambiguities and poison pill provisions that have created confusion for concealed carry holders, law enforcement and the courts. Nine years ago, Governor Robert Taft refused to sign Ohio's concealed carry legislation unless it contained language to address safety concerns of anti-gun activists. None of the provisions have proven helpful in protecting public safety nor is there any evidence they have reduced gun-related crime. The bill would make three changes to Ohio law. First, Ohio would join many other states in automatically honoring other state's concealed carry licenses, and allowing the Attorney General to sign more agreements with other states. Second, HB495 would also remove a vague and unenforceable "demonstrated competency" requirement, and third, the law would clarify the definition of a loaded gun which currently is defined as a loaded magazine in a car on its own. |
USFS offering summer temp jobs
Thousands of temporary seasonal jobs with the Forest Service and its partners are available this summer and officials say now is the time to begin the application process. "Due to the nature of much of our work, such as wildfire fighting and seasonal recreation programs, we anticipate hiring many temporary workers," said U.S. Forest Service Chief Tom Tidwell. "These jobs will provide economic relief for many unemployed Americans and help stimulate local rural communities." Annually, the Forest Service and its conservation partners hire over 15,000 people for summer positions. Of that total there are around 12,000 openings during the peak fire season months for those seeking temporary work in the fire and aviation management field. Seasonal job opportunities also provide first-hand knowledge of natural resource management to the new hires, many of whom are young adults. These work experiences may instill lasting and meaningful connections between the future stewards of our land and America's great outdoors," Tidwell said. |

Ruger offers 10/22 takedown
Sturm, Ruger has introduced the Ruger 10/22 Takedown. Readily separated into two subassemblies offering a convenient transport and storage option for the popular Ruger 10/22 rifle. The barrel and forend are easily separated from the action and butt stock by pushing a recessed lever, twisting the subassemblies, and pulling them apart. Reassembly is the reverse of takedown and is quick and easy. The friction fit lockup of the assembly joint is simple to adjust but will rarely need re-adjustment after the first assembly. The lockup is secure and repeatable, ensuring an accurate return to zero, even when receiver-mounted optics is used. The rifle is shipped in a ballistic nylon backpack-style case that features internal sleeves which hold the subassemblies.
