SC Code 41-9-260 Does Not Prohibit Denying Compensability after 150 Days, but the Doctrines of Laches and Estoppel Can

The question recently arose whether South Carolina Code of Laws 42-9-260 acted as a statute of limitations to deny compensability. If the statute gives the carrier 150 days to unilaterally suspend compensation when the claim is deemed not compensable, is the right to raise compensability as a defense barred after 150 days?   The issue was addressed by the Court of Appeals in the case of Jervey v. Martint Environmental, Inc., Opinion No. 4930 (filed January 23, 2012).

 

SC WCC Revises Commuted Value Table

At the regular business meeting January 17, 2012, the South Carolina Workers' Compensation Commission approved a revised 5% Commuted Value or Net Present Value Table as authorized by SC Statute 42-9-301 and Regulation 67-1605. The new table was approved in order to correct calculation errors in the previous table, and it is effective immediately.

 
It is important to note that the revised commuted value table reduces the number of weeks paid. For example, under the old table, the present value of 500 weeks was 408.2957. It is now 396.8116. The present value of 340 weeks, the maximum number of weeks for a partial wage loss award, has been reduced from 294.1584 to 289.8974.

Give South Carolina's Children a Chance - Participate in the SC Kids' Chance Memorial Golf Tournament

Collins & Lacy, P.C. is asking businesses to give South Carolina children a chance by participating in the 15th Annual Dennis Brewer Memorial Golf Tournament.

 

Since 1992, Kids' Chance of South Carolina, Inc. has been helping the children of injured workers pay for school. During its nearly 20 years of service, Kids' Chance of South has awarded more than $700,000.00 in scholarships to deserving students. Kids' Chance raises that money through programs and events like the upcoming golf tournament.

 

The tournament is Friday, March 30, 2012 at The Members Club at Woodcreek in Columbia, S.C. Kids' Chance is currently in search of players and sponsors for this important, yet fun event.
