Secretary of Labor, Hilda Solis in 2009: "As I have said since my first day on this job the Department of Labor is back in the enforcement business".
They have increased enforcement inspections and they are not backing down.
Coming is a new OSHA standard called "Plan/Prevent/Protect" that will require each employer to implement an Injury and Illness Prevention Program tailored to the actual hazards in that employer's workplace.
The DOL warns that employers who fail to take these Plan/Prevent/Protect measures to comprehensively address risks will be considered out of compliance with the law and subject to remedial action.
According to the DOL, the plan cannot be a mere paper process. In other words if you have a generic safety plan and it is gathering dust or locked away in a filing cabinet, you will not be in compliance.
Even without this new standard there are current OSHA training requirements, specifically for your business, that you must comply with.
There is no exemption from training requirements unless you are a self employed individual.
