Message from the President
The tragic disaster that cost the lives of four men on Christmas Eve when their swingstage collapsed in Toronto is a sobering reminder to us all of the dangers of our industry and our responsibilities to work safe. The only bright side is the rarity of multiple fatality accidents and the knowledge that Ontario fatality statistics are at an all time low and the best in the Country. This is the result of many years of dedication by the entire industry and the enforcement of Health and Safety Law, and why this disaster is important.
While all fatal accidents are tragic and preventable, all accidents are not equal and there is a category that rarely is seen, but must remembered, is one that demands criminal prosecution under Bill C-45 that was passed in Parliament in 2004.
Bill C-45 is often called the Westray Bill because it came about because of a coal mining disaster in 1992 that resulted in the deaths of 26 men. The inquiry into the accident found that there had been repeated complaints and warnings about conditions in the mine that were ignored by management and ownership and the methane explosion resulted from ownership's inaction. The problem was that the ownership was based in Ontario while the mine was in Nova Scotia and because Safety Legislation was a Provincial matter, the ownership was largely off the hook. This lead to years of lobbying to create a Federal criminal offense in safety related accidents that one can think of as criminal negligence causing death that could be used where ever the negligence occurred in Canada.
This recent accident brings C-45 to mind. While we do not know all the facts, the ones we do know are shocking and unacceptable. The people I talk to think it should not be treated as business as usual by the Ministry of Labour. Some have called for a full provincial inquiry, but general opinion seems to be you don't need an inquiry when the facts seem pretty black and white and we have laws in place that need enforcing. We have mandatory fall protection training, we have inspection and enforcement as the Ministry of Labour is reported to have visited the site twice and issued orders. What we did not have was compliance and possibly negligence. What we want to know is what happened and are the police investigating and contemplating criminal charges.
What we do not want is for the Ministry of Labour to follow standard practice where charges are not filed until 11 months and 29 days after the accident. By the time charges are laid and the case goes to Court it is often over 2 years before an outcome and the urgency is lost on both the industry and the public. The same thing happens when you go the inquiry route. We want a prompt police investigation while the tragedy is still fresh.

Due to the tragedy on Christmas Eve when four workers plunged to their deaths, and a fifth remains in hospital, an alert regarding suspended work platforms was sent out.
The purpose of this alert is to provide information about the safe use, maintenance and inspection of suspended work platforms and control measures to minimise the risks associated with using this equipment. This alert is intended to increase awareness of the safety requirements for using suspended work platforms but does not replace the need to fully evaluate the nature of the equipment being used and the work being performed in order to comply with the Occupational Health and Safety Act (OHSA) and its regulations. Merit Partners with the Ontario Electrical League
Merit OpenShop Contractors Association is pleased to announce a new strategic alliance with the Ontario Electrical League (OEL), who represents electrical contractors (primarily open shop) across Ontario. We have been working with the OEL on political issues that impact the Members of both Associations, such as WSIB and the College of Trades.
The Merit benefit plans will become the recommended benefits plan for OEL members. New electrical contractors joining the Merit HourBank benefits plan will automatically become members of both Associations.
We will be meeting OEL members at the local chapter meetings and conference during 2010 and we hope to see you there.

Benefit News
Merit Benefit Plan New Rates
The new rate for the Merit HourBank plan is effective with your February remittance of January 2010 hours. Please use the correct form and rates. If you are using the Excel spreadsheet (which we strongly recommend), you will receive an email with the 2010 form. If you are still using the paper format, you should have received those forms by mail already. If your employees pay the life and disability premiums, the deduction remains $.21/hr.
The new rate per hour is:
Core Plan $1.08
LTD $ .13
Participation fee $ .12
$1.33
(STD) optional $. 10
