ViewsVoluntary Sector Can Influence DCC Budgets
Derby City Council is currently consulting on its proposed budget for 2011-12, including the proposed reductions in its grants to voluntary and community groups.

If you would like to have your say then please complete the Budget Consultation Survey. The Budget Consultation Survey is in addition to the current consultation on the review of the Derby City Council Grant Aid Strategy, which outlines the new strategic direction and commissioning priorities, featured in the last edition of Reach Out.  Click here to take part in DCC's Grant Aid Strategy Consultation. DCC have produced a document to answer questions arising from the Voluntary Sector Forum and The Compact meeting. To view the document visit the Community Action website.

If you would like to discuss any issues relating to these consultations you should either contact the DCC officer who manages your funding, or call Matthew Allbones at Community Action on 01332 227721 or email Matthew Allbones.

High Court Allows Judicial Review of Public Sector Cuts Decision

Service users of a charity affected by planned funding cuts of London Councils took out judicial review proceedings against the cuts and on Friday 28 January 2011, Mr Justice Calvert-Smith gave judgment for the claimants.

The challenge relates to London Councils' plans to cut £10m from the £26.4m in funding provided by London Councils to voluntary sector organisations in London. The cuts would have affected over 200 voluntary and community sector organisations in London, and tens of thousands of Londoners.

The Judge held that London Councils' consultation process was flawed and that they had failed to meet their statutory equality duties. He quashed all the funding cut decisions for the 200 plus projects and said that London Councils must re-run the process, this time with full equality impact assessments.

The claimants solicitor, Louise Whitfield, a specialist in claims raising equality issues and cuts to the voluntary sector, said:

"This case establishes that even in the current economic climate, it remains of paramount importance that public sector funding cut decisions are properly assessed for their gender, disability and race equality impacts.  If they are not, public sector funding cut decisions will be unlawful.

London Councils simply did not consider the full effect of their £10 million cuts on the hundreds of voluntary sector groups and tens of thousands of members of the public who would be affected. They will now be required to do so."

The case shows that it is possible to successfully challenge funding cut decisions on a wide range of issues aside from the actual amount of the cuts.
