It seems like times are getting tougher for our clients.  We see more being forced to go without health or car insurance.  Clients are losing their

jobs, homes and hope.  As more businesses suffer and close, the gap between those who have and those who do not, continues to widen.  

Hon. Judge Scott Bernstein We, together with lawyers like Scott Kotler, Marco Britt and Jessica Laleh participate in providing free legal care to Miami's homeless every month, through Lawyers to the Rescue at the Camillus House.
 
The number of clients increases every week.  We congratulate Lawyers to the Rescue for recognizing great lawyers, like Judge Scott Bernstein who are committed to helping those in need, at their first Public Service Awards Ceremony, held at the University of Miami School of Law last week.

We are concerned that as our economy struggles, businesses, hospitals and our own government, in order to ensure profits, may end up cutting corners and jeopardizing our safety. This month's issue of the Talisman is dedicated to placing your safety first.

BICYCLE SAFETY 

 

As a former bicycle racer I know that South Florida is a very dangerous place to ride a bicycle. The recent tragic death of a 36 year old Miami father and husband, who was killed in a hit and run accident while on his bicycle, causes one to wonder how these types of catastrophes can be avoided.  

   

 

 

 

Florida has very specific laws regarding how to ride a bicycle on public streets. Florida Statute §316.003(2) defines a "bicycle" as a vehicle that is human powered and capable of achieving speeds over 20 mph. Florida Statute Section 316.2065 mandates that bicycles ridden after sunset and before sunrise have a front white light that is visible from at least 500 feet and a rear red light that is visible from 600 feet.  Read more here.

SAFETY AT WORK

A 27 year old Miami woman, raped at the Pleasure Emporium in Miami Gardens while working the midnight shift, is one of the more terrifying cases we have seen in recent memory.  The assailant, armed with a pistol, ordered the women to give him all the store's money and lie on the floor.  He proceeded to rape her and fled.  The victim hit the panic button and called 911 on her cellphone.

Businesses have an obligation to provide a safe place, for both their customers and employees.  Surveillance cameras and proper lighting are minimally necessary in most businesses, but do little to discourage crime.  Businesses have to take more proactive steps, like limiting operating hours or hiring security guards, when necessary. SAFETY AT SCHOOL 

According to the U.S. Consumer Product Safety Commission, the Slalom Glider Slide, manufactured in Delano, Minnesota, has been recalled due to reported injuries caused as a result of children falling while sliding down the chute.

To date, reported injuries include fractured arms, legs, clavicles and a bruised spleen.
