The Boy Scouts Would Be Honored

Fleur de Lis

Assembly Member Mike Morrell (Republican of Cucamonga) has introduced a bill (ACR 94) which would honor the Boy Scouts of America.

The bill says "the Legislature acknowledges that the Boy Scouts of America have provided a strong program for youth for 102 years, and commends the Boy Scouts of America for its accomplishments and the lives positively affected by scouting".

This legislation completely ignores the long standing policy of the Boy Scouts of discrimination against gay men and boys. In fact, the Boy Scouts have repeatedly defended their right to discriminate in multiple court battles.

Criminal Justice - A System of Bondage

Many people assume that slavery or bondage of the African American community ended at the end of the civil war. However, a recent documentary on Public Television demonstrates that Black bondage continued long after that time.

During the brief period of "Reconstruction" after the civil war, Blacks in the south gained considerable power. Many of them were elected to local and state government office. However, by about 1875, the north, and the federal government, lost interest and White southerners regained control of state and local governments.

Once that happened, in many southern states, local authorities began a campaign of arresting Blacks. Often the charges were false or for minor violations. All too often, the accused were tried and convicted in quick order, with little attention to the rights of the accused to a fair trial.

DOMA Defeated Again

Gay Men Wedding Ring

Last month, on February 22, US District Judge Jeffrey S. White ruled that the federal Defense of Marriage Act (DOMA) is unconstitutional. He said the federal law violates the US Constitution's guaranty of equal protection under the law.

This decision came in a case brought by Lambda Legal on behalf of Karen Golinski and her wife Amy Cunninghis. Golinski has been employed for 20 years by the US 9th Circuit Court of Appeals.

In 2008, Golinski had attempted to add Cunninghis to her employer provided health insurance plan just as California state employees can do now for their same sex spouses or domestic partners.

In two separate administrative orders, the Chief Justice of the 9th Circuit Court of Appeals (Alex Kozinski, acting as Golinski's employer) instructed that Cunninghis be added to the coverage. The federal government ignored these instructions and told the insurance company providing Golinski's coverage not to add Cunninghis to their health plan.

In 2010 the office of the Chief Counsel, of the Internal Revenue Service issued a memorandum which discusses the rules which domestic partners in California should follow when completing their federal income tax returns.

The same rules probably apply to same sex couples, who married in California in the summer of 2008, and whose marriages are still recognized by the state of California.

The memorandum is Memorandum 201021050 (also known as CCA 201021050). You may see a copy of it by clicking on the link at the end of this article, and then clicking on the link in the web based version of this letter.

According to a ruling of an IRS Tax Court, transgender people, who undergo sex reassignment surgery, may be able to claim at least part of the cost of that surgery, and of hormone therapy, as a medical deduction on their federal income tax return, assuming they have the documents to support those expenses.

People may see a copy of the tax court ruling, by clicking on the link at the end of this article, and then clicking on the link in the web based version of this article.

Race - AIDS - Family Planning - The Connection

You may well ask, what is the connection between race, AIDS, and family planning? Here is the connection.

According to the US Centers For Disease Control (CDC) there were 21,652 new HIV infections among African Americans in 2009. That's more than any other ethnic group in the nation, and it is almost twice as many infections as in the White population.

Those numbers are particularly stark when you consider that, according to the US Census Bureau, African Americans are only 12.6% of the people in this nation, while Whites are 72.4% of the population.
