THE LOCAL SCANDAL


Dear Friends:
I received a lot of slack from readers on both sides of the Wendy Runge
issue, why I supported Wendy, why I didnt support Wendy.
My point is to provide you with a healthy dose of skepticism
for the American Judicial System.  I am not a rabbi, but it appears to
me that even when a secular decision is handed down, it does not relieve us as earnest Jews from our mandate of "Dan L'kaf Zchut."  Until Moshiach comes, and we know that the Judicial system is in the hands of Torah Jews, our mandate is to Dan L'kaf Zchut.

I have kept quiet about a local scandal.  Again, I was bombarded by readers who begged me to say something about the matter.  So this is what I will say:  I am deeply saddened by a few things:
I am deeply saddened beyond words that this man with whom I grew up, who spent his shabbasim teaching boys how to lain and daven, who comes from a wonderful family that is a pillar of the community, and who earned the trust of this community had to resort to this alleged act.
I am deeply saddened that while there are criminals out there who do heinous crimes and dont make the front page, that the media had to have a field day with the story and portray him in the worst possible light.
I am deeply saddened that although we all know this wonderful family, we are so quick to look at the act and not see the sadness of the man.
Lastly, I am deeply saddened that if he needed money, that he did not feel he could turn to his friends AND THAT THERE IS NO UNITED COMMUNAL FUND to ask for help that he needed, both monetarily and emotionally.
Ayni Ayni yardah mayim.  I consider this a community failure in so many ways.  I have begged this community to unite to come up with a communal funds for those who need.  But each Rabbi and community needs his bit of karkah, and this failure to unite is a fundamental failure in the community.

The D.A. Stole His Life, Justices Took His Money

In an important prosecutorial-misconduct case this term, the Supreme Court's conservative majority threw out a $14 million jury award for a New Orleans man who was imprisoned for 18 years, including 14 on death row, for a robbery and a murder he did not commit. One month before John Thompson's scheduled execution, a private investigator discovered that prosecutors had hidden evidence that exonerated him.

After his release, Mr. Thompson won a civil lawsuit against the Orleans Parish district attorney's office, which had been led by Harry F. Connick, for its gross indifference to the incompetence of the prosecutors who violated his constitutional rights.

Justice Clarence Thomas, writing for the 5-to-4 majority in Connick v. Thompson, said the D.A.'s office was not liable for failing to train its lawyers about their duty under the Constitution to turn over evidence favorable to the accused.

The lawyers had kept secret more than a dozen pieces of favorable evidence over 15 years, destroying some. That failure to provide training, the court said, did not amount to a pattern of "deliberate indifference" to constitutional rights.

Justice Ruth Bader Ginsburg wrote a powerful dissent, which she read from the bench.

The Thompson ruling tore down an essential bulwark for ensuring that prosecutors are properly trained, and severely diminished the right of citizens everywhere to hold them accountable. The Supreme Court's decision to shield the district attorney's office from having to pay a monetary award for stealing 18 years of Mr. Thompson's life is shameful.

Innocence Project New Orleans found that in 9 of 36 death penalty convictions while Mr. Connick was chief prosecutor, his office suppressed exculpatory evidence. It had one of the worst records in America on that score.

The New Orleans district attorney's office is by no means alone in its failure to ensure justice in capital cases. Failure to turn over evidence is a chronic problem. Its consequences are magnified by the government's advantage over the inexperienced and inept defense lawyers who are often assigned to indigent defendants. Many of these violations are exposed. Many other instances may never be uncovered.

The capital punishment system in this country has put many innocent people on death row. It cannot be fixed and should be repealed everywhere. With this ruling, the court made it even more likely that innocent people will be railroaded by untrained prosecutors - with the terrible prospect of their being put to death for crimes they did not commit.

The Avraham Yonah Reading Group


There are many people in our community who are home bound or for various reasons cannot get out often and seldom have visitors. The Avraham Yonah Reading Group is a volunteer group consisting mostly of women, who go to these peoples homes and read to them. It gives these individuals an opportunity to make friends, have consistent visitors and know that others care about them. 

The organization is intended to help people who are home bound, elderly, ill and in treatment or anyone else who may benefit from this service. Volunteers will visit the individuals home for approximately 1/2 - 1 hour, and will either read a book, learn Torah, play a game or just talk with the person depending on their preference. There will be a different volunteer going each day of the week, depending on how many days are requested by the person in need. It is hoped that each volunteer will continue to visit on the same day of every week. 

If you know of anyone who could benefit from this service, please contact us. 

We hope you will be interested in volunteering to be a part of this wonderful chessed and join us in reaching out to our friends and neighbors who are in need and hopefully making a difference in their lives.
