Legal Decisions and Verdicts

USF&G v. Michigan Catastrophic Claims Association.
Wayne Miller argued this case in the Supreme Court. The Court has now made clear that the "MCCA" does not have the power to approve individual No-Fault insurer claims decisions and must therefore reimburse such payments...

Scott v. State Farm.
Associate Milea Vislosky represented Plaintiff Scott in this case where the Court of Appeals made clear that the standard required to prove the relationship between a benefit and a motor vehicle accident is relatively easy to meet, confirming the liberal nature of the no-fault system...

Regents of the University of Michigan and University of Michigan Health System v Titan Insurance Company
Ronni Tischler argued this case in the Supreme Court in March, 2010. This important case is currently under review by the Supreme Court based on the conflict between MCL 500.3145 regarding the "one-year back rule" and MCL 600.5821, which states in essence that actions brought by the state or political subdivisions are not subject to any statutes of limitations.  We are awaiting the decision and will discuss it further once the Order of the Court  comes down.

What happens if I lose my income due to injury?

If you cannot work due to your injury or lose your job due to being disabled from work, your No-Fault insurer is obligated to pay wage loss benefits up to three years following the accident. The maximum dollar amount per month you can receive is set by statute and amended each year. The current maximum wage loss benefit is $4878.00 per month. To read the actual statute identifying Wage Loss as a compensable benefit click here.
