THE ARTS

Woodland Boulevard blossoms into an artist's garden of color every November, as DeLand, Florida hosts the Annual DeLand Fall Festival of the Arts. Over 180 National Artists will display and sell their art work in the historic downtown shopping district, just in time for holiday gift-giving.  

WHAT ARE MY OPTIONS?

Homeowners who are unable to make the payments on the mortgage on their home have several options to consider to avoid foreclosure.

 

The first option you have is to seek a modification of the loan. You need to contact the lender to see if the lender will agree to modify the terms of the mortgage and note including, an adjustment in the interest rate, the term of the loan, and the payment amount.

 

 Another option is for you to give a deed in lieu of foreclosure. Here, you offer to convey the property back to the bank in lieu of the bank filing a foreclosure action against you. The lender cannot accept a deed in lieu if there are any subordinate liens or encumbrances on the property.

 

A third option is for you to try to sell your home and satisfy the outstanding mortgage. The process of selling the home for less than is actually owed on the mortgage is called a "Short Sale". The primary benefits of a short sale are that you have a say in the sale of your home. You may not receive any proceeds or other benefit from the short sale. Lenders generally will only consider the above options if the mortgage is in default or close to default, you have suffered a recognized hardship (eg. unemployment, medical issue, death, bankruptcy, etc.), the property's market value has dropped, and you have little or no assets from which the lender could recover a deficiency judgment.

 

If the lender agrees to one of these options, you need to negotiate with the lender as to any amounts due. Lenders are not required to release the borrowers from any remaining balance due on the loan and may require the borrowers to repay a portion of the remaining debt. If the lender does release the debt, the lender must issue a 1099 for the forgiven debt. However, there are many situations in which such forgiveness is exempt from such tax liability.  

Networking Luncheon  

 This past week, Bauer and Associates hosted its first  Professional Networking Luncheon in our office.  The purpose of this gathering was to get to know a portion of our area business owners and service professionals better, both personally and professionally.  It also provided each of us the opportunity to develop a referral network that we can draw from to recommend businesses and companies that we know to our clients and other people that may be in need of these services.

  

Our guest list included people in the senior care industry, both private care and facility care; rehabilitation services; developmentally disabled care; personal guardian and benefit service representatives; on-line commerce and private financing. 

  

It was a pleasure to spend time with these business owners and their liaisons and enjoy a delicious lunch provided by Bellini's Italian Restaurant!

 

We look forward to hosting future such events and getting to know more about our community and its businesses and agencies!
