FIND TIME TO REACH OUT...........
 
 Because a great part of my practice involves estate planning, I often get to meet with elderly clients.  One of my favorite things to ask is "what would you do differently if you had your life to live over again?"
Not surprsingly, most responses include the desire to spend more time with loved ones.  Overwhelmingly, improving relationships is a common theme.
 
My challenge to each of us this month is to work on strengthening our connections with family and friends.  Take your spouse out on a "date"; call or visit a parent, child, or sibling; write a note to a friend; or invite someone to dinner.  Your reaching out to someone will be a real blessing to them.  I am also confident that it will be something that you will not regret!

Couple planning Living Trusts ~ An Estate Planning Option

A living trust is a legal instrument which holds title to the personal assets of an individual person or family, including bank accounts, real estate, LLC and stock interests, etc.  Like a will, a living trust contains your instructions for the distribution of all your assets after you die. 
 
A primary difference between a will and a trust is that a trust avoids probate, whereas a will does not.  Probate of a will requires filing of a probate proceeding, newspaper publication notices, letters to all heirs even if disinherited and statutory waiting periods. Also, all records of the probate are public information. 
 
The living trust is also beneficial should a person become incompetent or unable to handle his or her affairs while alive as a successor trustee could take control of the trust assets and manage them without the necessity of a court reviewed guardianship.

Utilizing an attorney-prepared living trust is a method of avoiding the probate process.  It is also a vehicle used to take full advantage of the benefits of certain estate tax credits. While living trusts may not be cost effective and appropriate for all, because the living trust eliminates probate, and, under some circumstances, can greatly reduce estate taxes, it may save your heirs some money at the time of your death so a greater portion of your assets will transfer to your heirs.
