Kirk T. Bauer
Mr. Bauer began the practice of law in DeLand, Florida in 1985. He established the law firm of Bauer and Associates in 1992, representing local individuals and businesses. His core beliefs have always been that each client deserves to have an attorney who will give personal attention to the client's case and will be well prepared. Mr. Bauer attended Stetson University and Stetson University College of Law. He is a member of the Volusia County Bar Assn. (Past President) and the American Bar Assn. He is licensed to practice in all Florida Courts. Mr. Bauer and his wife, Martha, have four children and three grandchildren. They have resided in DeLand for over 30 years. Mr. Bauer is also an instrument rated pilot and enjoys being active in his church and various community events and activities. |

Estate Planning..Why Do I Need It?
 Each person should do "estate planning" to make sure that his or her assets pass, after death, to those persons or organizations that he or she desires. It is also wise to make certain health care desires known and appoint individuals to assist when the time comes to help with health and financial issues.
When a person dies, any and all assets that are only in the decedent's name will need to be transferred through the "probate" process. This is where a judge decides who is to receive the assets of the decedent. To make this determination, the Court must first establish whether the decedent made any written directions on what was to happen to his or her estate assets. These directions are typically found in a document called a "Will".
A Will is a written document, meeting the requirements of Florida Law, where a person describes what is to happen to his or her assets after death. If no such Will exists, then the assets are distributed to heirs as determined by the Florida Statutes.
The Court then appoints a personal representative in the probate case to locate all of the decedent's assets, pay all lawful claims, and then distribute the decedent's assets to the beneficiaries who are to receive them. The benefit of doing estate planning, including the creation of a Will, is to make sure your assets go to whom you desire.
