President Ford Signs Law Requiring Schools to Provide Students with Disabilities FAPE

Twenty-one years ago President Ford along with Congress passed legislation that was intended to improve opportunities in education for "handicapped children"* and adults through the provision of a Free Appropriate Public Education (FAPE). This law was called Public Law 94-142. This law provided that "handicapped children" and adults ages 3-21 be educated in the Least Restrictive Environment (LRE) to the maximum extent appropriate, meaning that they are educated with children who are not "handicapped" and that special classes, separate schools or other removal of children from their regular educational environment occurs only when the severity of the handicap is such that education in regular classes cannot be achieved.
*PL 94-142 specifically refers to individuals with disabilities as "handicapped" children.

Bill Would Regulate Use of Seclusion and Restraint in School
|
House Bill 2444 passed favorably out of the Children and Families Committee on February 14, 2012. Now the bill will go to the full House for consideration. This bill would regulate the use of seclusion and restraint in school districts for students K-12. Currently, the Kansas State Department of Education (KSDE) has guidelines in place. Letter Provides Guidance Under ADA Amended Legal Standards

The U.S. Department of Education's Office for Civil Rights issued a Dear Colleague letter concerning the Americans with Disabilities Act Amendments Act (Amendments Act). The letter and accompanying Frequently Asked Questions document (FAQ) provide additional guidance on the requirements of the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act (Section 504) in elementary and secondary schools. The Amendments Act broadened the meaning of disability.
