Disability Benefits Get Reprieve Under Federal Debt Deal

Do I Have to Pay Enrollment Fees?

Yes

The federal regulations, at 300.39, define the term "special education" as "specially designed instruction, at no cost to the parents to meet the unique needs of a child with a disability..."  But, at 300.39(b)(1), that same regulation says: "At no cost means that all specially designed instruction is provided without charge, but does not preclude incidental fees that are normally charged to nondisabled students or their parents as a part of the regular education program."

 

This means that parents of children with disabilities are subject to the same fees as other parents.  What is free are the services, devices and placements specified in an IEP.
