News and Events:
December 2010

Greetings!

Happy holidays!  As this year and this decade come to a close, I hope that you have much to be thankful for.  The NHWBA does, and on its behalf, I want to extend a personal invitation to you to attend our holiday party tomorrow night at UnWine'd in Manchester, where we will enjoy good food, good wine, good networking, and good fun, as well as be collecting donations for a good cause - The Salvation Army / Union Leader Santa Fund.  The NHWBA is trying to give back to our community, which is still in dire need during this period of economic recovery, and we encourage you to join us in raising money for the Santa Fund to make the holidays brighter for children in New Hampshire.  More information about how the NHWBA is giving back is in this newsletter.

As this decade comes to a close, the New Hampshire Judiciary has another historic first with the appointment of Justice Linda Dalianis as the first Woman Chief Justice of the New Hampshire Supreme Court, thirty years after her historic appointment as the first woman on the Superior Court Bench and ten years after her appointment as the first woman justice on the Supreme Court bench.  We have come a long way, with Justice Dalianis paving the path to the bench for women statewide.  The NHWBA congratulates her on her successes, her achievements, and her leadership to women lawyers in our state.  Her appointment is well deserved and well earned and has opened opportunities for qualified women at every level of the judicial branch.  More information about Justice Dalianis' appointment, as well as the appointments of Justice Robert Lynn and Judges Kristin Spath and James Carroll is below in this newsletter.

I wish you all good health, great success and ongoing prosperity for the coming year and hope to see you at our holiday party.

Best regards,

Holly B. Haines

Robert Lynn as an Associate Justice of the New Hampshire Supreme Court; Kristin Spath as a Judge of the Concord District Court; and James Carroll as a Judge of the Laconia District Court.

Justice Dalianis has paved the path to the bench in New Hampshire for all women lawyers.  She was the first woman justice appointed to the New Hampshire Superior Court in 1980.  She served as the first woman Chief Justice of the Superior Court and she was the first woman justice appointed to the New Hampshire Supreme Court in 2000.  She is the first woman in New Hampshire history to be appointed Chief Justice of the Supreme Court.

Judge Lynn has served as the Chief Justice of the Superior Court for the last seven years.  Prior to this, he served as an Associate Justice of the Superior Court for eleven years.  Before his appointment to the Superior Court in 1992, Judge Lynn worked at the U.S. Attorney's Office and in private practice in Concord, New Hampshire.

Kristin Spath, a long time member of NHWBA, has served as an Associate Attorney General and Chief of Staff at the New Hampshire Department of Justice.  Prior to becoming a prosecutor at the Department of Justice, Spath served as a New Hampshire and federal public defender.
James Carroll has served as the County Attorney for Belknap County since 2006.  He served as the Laconia city prosecutor from 1992 to 2002, and worked in private practice prior to 1992.

The NHWBA congratulates all of the new appointees on their achievement.  For more information on gender diversity in the New Hampshire Judiciary and on Justice Dalianis's historic path to the bench, please read:  Balancing the Scales of Justice - Achieving a Critical Mass of Women on the New Hampshire Judiciary by NHWBA President Holly Haines.  It includes an interview with Justice Dalianis and other women justices on the New Hampshire Supreme and Superior Courts on these issues that are very important to our organization.

NHWBA in the Community

Recent Charitable Efforts of NHWBA

Since September 2010, the NHWBA has participated in several charitable events in an effort to give back to the community.

For the American Cancer Society, the NHWBA sponsored a team of walkers for the Making Strides Against Breast Cancer Walk in Manchester on October 18.  Our team raised $2,915 in donations to support breast cancer prevention efforts!

For the Manchester Community, the NHWBA also assembled a group of 9 volunteers to help pack holiday dinner boxes at the New Horizons Soup Kitchen and Shelter, which were then distributed to families in need in Manchester.  These nine volunteers also manned the food line and distributed food to 85 families in need.

Finally, the NHWBA made a charitable contribution to benefit the Children's Hospital at Dartmouth (CHaD).  The contribution was made through sponsorship of Warren Miller's Ski Film Night to Benefit Kristen's Gift, the pediatric oncology fund at CHaD.  This event took place at the Palace Theatre in November.

At our holiday party we will continue these efforts by raising money for the Salvation Army / Union Leader Santa Fund.

The NHWBA will continue to support the community in the coming months and years through charitable outreach.  We rely on our members to participate in our volunteer activities and thank those members who have given their time and made financial committments to our efforts to participate in the community.  Thank you for your continued support!

Federal Legislation Proposed to Guarantee Paid Sick Days

According to the National Partnership of Women & Families, four in ten working women, or more than 13 million, working in businesses with 15 or more employees are unable to take a paid sick day when they or a family member are ill.  Nearly 64% of mothers work outside the home, and their earnings make up a substantial share of family income. 76% of African-American women, 67% of Asian-American women, and 61% of Latina women with children under 18 are in the labor force. One in three working women report that they care for an elderly relative, persons with disabilities or special needs children.

Women are disproportionately affected by this burden.  Half of working mothers miss work when a child gets sick and 50% of this group does not get paid when they take this time off. Among low-income working mothers, two in three report losing pay due to absences for sick children. In addition, one in eight women overall and one in five women with children reported that they or a family member had been fired or disciplined by an employer for taking time off to deal with illness or to care for a sick child or family member.

Several cities, San Francisco, Washington, D.C., and Milwaukee have passed laws guaranteeing paid sick days to workers in their cities, but there is no federal legislation guaranteeing paid sick days. The Healthy Families Act (H.R. 2460/S.1152) was first proposed in May 2009.  It would enable workers to earn up to seven paid sick days a year to recover from short-term illness, to care for a sick family member or to seek routine medical care. This legislation seeks to offer a solution to the problems and inequities described above.  For more information on paid sick days, visit click here. For more information on the proposed legislation, please visit this site.
