Campaign regulations for Non-profits
Important information for nonprofits in this election year:
The NonProfit Times quotes Angelia Dickens and Catherine Oetgen of the law firm of Perlman & Perlman LLP regarding important regulations for nonprofits during this election year. Here are their recommendations:
- Endorsements. Individuals employed by or associated with 501(c)(3) organizations are free to endorse, support or oppose candidates, but such activities should not be attributed to the organization or its tax-exempt status could be jeopardized. This usually means the individuals will not be able to make partisan comments in organization publications or at organization events, use the organization's resources or facilities or take stands without clearly and unambiguously indicating that their statements are theirs and not the organization's.
- Candidate appearances. Organizations can invite candidates to speak at events, but they should ensure that there is no indication of support or opposition for the candidate as a result of the appearance.
- Voter registration. A 501(c)(3) can organize get-out-the-vote drives as long as the activity is designed to educate the public about the importance of voting.
- Issue advocacy. Organizations are entitled to broadcast genuine issue advocacy communications that address public issues within 30 days of a primary election or 60 days of a general election for federal office.

A message from Independent Sector
The Independent Sector is seeking your help to nominate an outstanding nonprofit for the 2008 American Express Building Leadership Award. The award was stablished in 1999 to recognize outstanding organizations for their leadership in investing in the people of the charitable community, through an emphasis on the development of internal staff, board, and volunteer leadership. Independent Sector presents the award at the Annual Conference.

Boston College Law School
Community Enterprise Clinic
In January, 2008, Boston College Law School opened its first transactional law clinic, the Community Enterprise Clinic (CEC). The CEC is located at the law school's Legal Assistance Bureau in Waltham. Staffed by upper level law students working under the supervision of Professor Paul Tremblay, the mission of the CEC is to provide quality pro bono legal services on a variety of transactional and economic development matters to area nonprofits, entrepreneurs and small business owners.
Services to nonprofits may include incorporation, legal research, drafting of leases and contracts, obtaining federal tax-exempt status for new organizations and legal "audits" offered to clients to determine their legal state of health and to recommend and implement corrections or improvements.In addition, students may brief boards of directors on their roles and responsibilities, as well as on legal developments impacting the sector. The CEC will not represent clients in litigation matters.

The Community Enterprise Clinic will make every effort to provide you with a prompt response to your inquiry. The Clinic will consider a variety of factors when determining whether to accept a project, including the nature of the project, student availability and needs of the nonprofit. | |
