In light of the recent events at Penn State and the discussion around reporting suspected child abuse we are providing the exact language from Nebraska Statutes and the LPS Certificated
Staff Handbook.

Reporting Child Abuse

Nebraska State Law and school policy mandates school officials to make a report to the proper law enforcement agency or the Department of Health and Human Services (Child Protective Services) when there is reasonable cause to believe that a child has been abused or neglected, or a child is in a situation which would reasonably result in abuse or neglect. According to Nebraska State Law, abuse or neglect means knowingly, intentionally, or negligently causing or permitting a minor child to be:

(a) Placed in a situation that endangers his or her life or physical or mental health;
(b) Cruelly confined or cruelly punished;
(c) Deprived of necessary food, clothing, shelter, or care;
(d) Left unattended in a motor vehicle if such minor child is six years of age or younger;
(e) Sexually abused; or
(f) Sexually exploited by allowing, encouraging, or forcing such person to solicit for or engage in prostitution, debauchery, public indecency, or obscene or pornographic photography, films, or depictions.

Teachers are to inform their principal or supervisor that they intend to make a report. Administrative staff may sometimes choose to make the report for a teacher. However, informing the Principal or supervisor does not end the teacher's responsibility; teachers are obligated to make certain a report was made if they do not do it themselves.

It is vital that the report be made as accurately and as soon as possible. To assure accuracy, you are encourages to document the date of the incident and specific statements or explanations made by a child regarding an abuse/neglect concern. Timeliness in making a report will assist in minimizing further risk to the child by allowing the police or Child Protective Services workers to interview the child prior to an evening or weekend. In cases of physical injury (e.g., bruising or other marks), it is essential the police observe and document the injury. A counselor, the school social worker or an administrator will help you.

Professionals Required to Report

Professionals required to report include:

  • Physicians, medical institutions, or nurses
  • School employees
  • Social workers


Reporting by Other Persons
Citation: Rev. Stat. § 28-711

All other persons who have reasonable cause to believe that a child has been subjected to abuse or neglect must report.

Standards for Making a Report
Citation: Rev. Stat. § 28-711

A report is required when:

  • A reporter has reasonable cause to believe that a child has been subjected to abuse or neglect.
  • A reporter observes a child being subjected to conditions or circumstances that reasonably would result in abuse or neglect.

Individual Responsibility
Citation: Rev. Stat. § 28-711
When a mandated reporter has reasonable cause to believe that a child has been subjected to abuse or neglect, he or she shall report to the proper law enforcement agency or the Department of Health and Human Services on the toll-free number.

The report may be made orally by telephone with the caller giving his or her name and address, and shall be followed by a written report.

Content of Reports
Citation: Rev. Stat. § 28-711
The report shall contain:

  • The address and age of the child
  • The address of the person having custody of the child
  • The nature and extent of the abuse or neglect or the conditions or circumstances that would reasonably result in abuse or neglect
  • Any evidence of previous abuse or neglect
  • Any other information that in the opinion of the reporter may be helpful in establishing the cause of the child abuse or neglect and the identity of the perpetrator or perpetrator.

90th American Education Week

 November 13-19, 2011
 

Distressed that 25 percent of the country's World War I draftees were illiterate and 9 percent were physically unfit, representatives of the NEA and the American Legion met in 1919 to seek ways to generate public support for education.
 

The conventions of both organizations subsequently adopted resolutions of support for a national effort to raise public awareness of the importance of education. In 1921, the NEA Representative Assembly in Des Moines, Iowa, called for designation of one week each year to spotlight education. In its resolution, the NEA called for: "An educational week ... observed in all communities annually for the purpose of informing the public of the accomplishments and needs of the public schools and to secure the cooperation and support of the public in meeting those needs."

  •  NEA's Bully Free: It Starts With Me

    A teacher in New York was teaching her class about bullying and gave them the following exercise to perform. She had the children take a piece of paper and told them to crumple it up, stamp on it and really mess it up but do not rip it. Then she had them unfold the paper, smooth it out and look at how scarred and dirty is was. She then told them to tell it they're sorry. Now even though they said ......they were sorry and tried to fix the paper, she pointed out all the scars they left behind. And that those scars will never go away no matter how hard they tried to fix it. That is what happens when a child bullies another child, they may say they're sorry but the scars are there forever. The looks on the faces of the children in the classroom told her the message hit home.

    Never too early, Never to late------RETIREMENT Information

     

    Dear Member,

    Retirement planning affects you each month whether or not you are close to retiring or retirement is years away. You contribute nearly 9% of your income to your retirement account each month. Nebraska has an excellent, well managed retirement system for public employees. The Nebraska Public Employees Retirement System (NPERS) under the direction of the Public Employees Retirement Board (PERB), administers several statewide retirement systems. It is your responsibility, no matter how young or old you are, to know exactly what you are contributing to and how we may be at risk for losing NPERS defined benefit program.

    Retirement Workshops: LEA is hosting a workshop on retirement. LPS is also offering two workshops. See information below. The Nebraska School Retirement workshops have not been scheduled yet in Lincoln for spring, 2012. Dates will be posted on the Nebraska Public Employees Retirement System website, npers.ne.gov when finalized. If you are 50 or older, you will automatically receive a State Retirement registration form in US mail. For more information on the State Retirement plan, the latest School Employees Retirement System booklet is available on the Nebraska Public Employees Retirement System website.

     Retirement planning workshop available for LPS staff

    Retirement Planning sessions have been scheduled by Human Resources for staff considering retirement at the end of the 2011-12 school year or prior to September, 2012. If you are planning to retire next spring/summer, we urge you to attend. If you have not made up your mind on when you are retiring but know it will be in the next few years, the workshop will provide information about the retirement process.
     

     Certificated Staff
    : Monday, January 23, 2012 - Lefler Middle School Auditorium; and Monday, January 30, 2012 - Scott Middle School Commons -- 4:30 to 6:30 p.m. (The same session is repeated.)

    During the workshops, we will discuss continuation of health/dental and other insurance benefits (Direct Bill and COBRA), the non-elective 403(b) procedures, pay for leave, how/when to apply for Nebraska school retirement, etc.

    Retirement Hearings

    The Legislature's Retirement Committee is holding public hearings on three important interim studies that deal with pension plans for public employees.

            November 22, 9:00 AM - State Capitol, Room 1525

    o   Retirement Committee hearing on LR210.

    o   LR210 calls for a review of the funding needs, benefits, contributions, and administration of the retirement plans managed by the Nebraska Public Employees Retirement System - school employees, state patrol, judges, and counties.  The Omaha School Employees Retirement plan may also be included.

     

    Senator Lavon Heidemann's LB680 would close the defined benefit plan for school employees and open a new cash balance plan for new school employees.  Further, there are discussions in Omaha about closing the fire fighters defined benefit plan and opening a defined contribution plan for new hires.

    It is critical that NSEA and NSEA-Retired leaders and members actively participate in these ongoing discussions to protect the current defined benefit plan for school employees.

    NSEA-Retired will organize retired teachers to participate in these committee hearings on behalf of their active teacher colleagues whom will be in the classroom teaching.

    The 1945 Legislature established the School Retirement System for Nebraska school employees.

    • All permanent public school employees who work at least 15 hours per week on an ongoing, regular basis, except Class V school districts, are members of the system.
    • Temporary and substitute employees not hired on an ongoing, regular basis, cannot participate.
    • School Plan members contribute 7.28% of gross compensation to retirement. This is matched by the employer at 101%. NOTE: The passage of recent legislation has increased contribution rates. Beginning 9/1/2011, contribution rates will increase from the current rate of 8.28% to 8.88%. On 9/1/2012 this rate will increase to 9.78%. On 9/1/2017 the rate will return to 7.28%.
    • A school employee may retire as early as age 60 with five years of service and receive a reduced benefit.
    • The normal retirement age for unreduced benefits is age 65 (must have at least one half year of service credit).
    • A school employee who retires prior to age 65 must have at least 5 years of service to apply for a benefit. Employees who retire prior to age 65 with less than 5 years of service are eligible for a refund.
    • In 1998, legislation for a "Rule of 85" benefit was passed. This legislation allows a member who is at least 55 to retire with unreduced benefits when the member's age and years of service equal 85.
    • As a defined benefit plan, lifetime monthly retirement benefits are based on this formula:

    Have you done your retirement homework?


    How much time have you spent planning for retirement? Do you know how much you will need to save? Are you familiar with the different options to save for retirement? A recent study released by the American Saving Education Council found only 42% of Americans have taken the time to perform a retirement needs calculation, and many are not saving enough for retirement. Those individuals who have devoted time for retirement planning often discover they need to save more.

    Each year NPERS provides seminars to help our members learn about their retirement plans and plan for retirement. We strongly encourage plan members to take advantage of these seminars and "
    do your retirement homework"!

    I Can Do It ---- FLEXtime Course on Classroom Management

    One of the largest concerns for teachers is classroom and behavior management. The I Can Do It! Program demonstrates effective classroom management skills through topics such as: Identification and demonstration of the elements for effective classroom management; different communication styles and how they relate to student/teacher/parent communication; suggested interventions for difficult behaviors encountered in the classroom; and tips that help create a smoothly flowing classroom. The course is designed for beginning teachers and paraprofessionals, but can be useful as a review for veteran teachers.

      

    LEA is offering this course through District Staff Development for FLEXtime credit. This is a 7 hour course. You may still take one  3.5 hour sessions.

    Important Reminders:

     

    Friday, January 6, 2012, is a teacher professional duty day that falls at the end of winter break just before the beginning of second semester which starts on Monday, January 9, 2012.

    1. Because there are no students in attendance on January 6th anyone who plans to be absent on that day does not need to pre-arrange their leave or receive permission to be gone. Pre-arranging and receiving permission to be gone after a break is only required for student days when a substitute is required.

    2. Because January 6th is a contract work day for staff, January 9th is not considered a day following a break (in this case winter break).

    3. No mandatory meetings of any kind (barring an emergency) can be called at the site or district level for teachers on January 6th. January 6th is a teacher professional duty day for staff to engage"in professional duties at their discretion" [5-4 (a) 1 in the Professional Agreement].

We will be awarding grants to buildings with the largest membership increases.     New membership enrollment must be a priority of the Association this year. We cannot afford our membership to decline, especially given all of the challenges that LEA/NSEA/NEA are currently dealing with and that loom on the horizon. This is a negotiations year, it is especially important that LEA go to the table with a solid voice and large percentage of members among the educators we will be representing. It is within this current and expected on-going environment that we ask for your concerted effort and challenge you to please do all you can to get current non-members to join.

    ELECTION 2011: HISTORIC VICTORY FOR WORKERS' RIGHTS!In a decisive victory for workers and the middle class, voters in Ohio overwhelmingly approved a referendum to repeal Senate Bill 5, a controversial bill signed into law by Governor John Kasich.  The bill was designed to silence the voices and strip away the collective bargaining rights of public workers.  Ohioans reacted to the politically motivated attack by taking matters into their own hands.  They collected more than a million signatures to trigger a citizen veto process to put a referendum of the unpopular law on the November 8th ballot.

    Lied Center Welcomes Peter Buffet

    Wednesday, November 16th at 7:30 PM

    Performance featuring Emmy Award-winning musician, philanthropist and NYT Best-selling author, Peter Buffett. On Wednesday November 16th, Nebraska Music Educators Association will be hosting Mr. Buffett and his concert series, "Life Is What You Make ItA Concert & Conversation with Peter Buffett".

     

    Celebrating the 75th Anniversary of the Nebraska Music Educators Association, the performance will take place at The Lied Center for Performing Arts, Wednesday, November 16th at 7:30pm.
