The U.S. Small Business Administration (SBA) has issued the first comprehensive revision to the 8(a) Business Development program in more than ten years.  This revision becomes effective March 14, 2011.
 
The rules cover a variety of areas of the program, ranging from clarifications on determining economic disadvantage to requirements on Joint Ventures and the Mentor-Prot�g� program. Some of the components of the 8(a) program that the revised regulations will affect include:
 
Excessive Withdrawals
  • "Excessive" withdrawal amounts have been increased for firms with sales of less than $1,000,000 (to $250,000 from the current $150,000), for firms with sales between $1,000,000 and $2,000,000 (to $300,000 from the current $200,000), and for firms with sales exceeding $2,000,000 (to $400,000 from the current $300,000). 
  • Officers' salaries are no longer generally considered withdrawals.
  • In order for termination or early graduation to be considered, funds or assets must be withdrawn from the Participant for the personal benefit of one or more owners or managers and any withdrawal must be detrimental to the achievement of the targets, objectives, and goals contained in the Participant's business plan.

The Impact of Federal, State, and Local False Claims Acts on the Construction Industry

The Federal False Claims Act (FCA) became law in 1863. Although it was originally intended to fight fraud by defense contractors, the majority of cases filed in the last few years involve medical and pharmaceutical claims. Given the recent changes in the FCA and increased federally funded spending on construction projects, it is likely the construction industry will experience an increase in FCA claims. In addition, the reporting requirements of the American Recovery and Reinvestment Act of 2009 (ARRA), the overall increase in federal funding for contractor oversight, and the weak economy are all likely to result in an increase in the number of FCA actions against construction contractors.

As the ARRA substantially increases access to federal funds by state and local governments, construction contractors that have little experience contracting with federal funds will for the first time have to comply with the many federal laws and regulations involved in government contracting. Each contract awarded with ARRA funds requires full compliance with the ARRA's reporting requirements as well as a number of other federal statutes and regulations, such as the Davis-Bacon Act (prevailing wages) and the Buy American Act.
