In this month's Client Update, because many of our clients have questions about the state of the market now, we begin by offering a market update examining the initial impact of the events in Japan on the insurance market.

Part two of our client advisory Third Party Over Claims continues our exploration of the topic, this time examining the role of contractual indemnification and the contractors general liability policy.

Third Party Over claims are often thought of as specific to New York because of the state's labor law issues, but as we explore in this client advisory, the exposure exists nationwide.

 

Kenner Steel Co is subcontracting on a project for which Ajax Construction is general contractor. When one of Kenner's employees is injured and chooses to seek additional compensation beyond workers' comp, he sues the general contractor - a third party claim. But the general contractor seeks contractual indemnification according to the subcontractor agreement and attempts to place liability back on Kenner.
