Dear Readers:
During the State of the Union address this
past week President Obama spoke for for only
two minutes about Comprehensive Immigration
Reform ("CIR").
The President needs to acknowledge that
putting Americans back to work and fixing the
economy cannot be separated from fixing the
broken U.S immigration system.
The President stated: "And we should
continue the work of fixing our broken
immigration system - to secure our borders,
enforce our laws, and ensure that everyone
who plays by the rules can contribute to our
economy and enrich our nation. "
The President continued by stating: "In
the end, it is our ideals, our values, that
built America - values that allowed us to
forge a nation made up of immigrants from
every corner of the globe; values that drive
our citizens still. Every day, Americans meet
their responsibilities to their families and
their employers. Time and again, they lend a
hand to their neighbors and give back to
their country. They take pride in their
labor, and are generous in spirit. These
aren't Republican values or Democratic values
they're living by; business values or labor
values. They are American values."
Rhetoric is great. Now it is time to act.
In a few short weeks immigration lawyers from
across the country will gather on Capitol
Hill to lobby for CIR. For information about

A December 30th, 2009 Memorandum from Donald
Neufeld, Acting Associate Director of
Domestic Operations, Citizenship and
Immigration Services ("CIS"), temporarily
extends the validity of civil surgeon
endorsements on Form I-693 for adjustment of
status applicants.

| NEW YEARS RESOLUTION FROM DOL: DOL ETA Prevailing Wage Determination Policy Guidance. |

The U.S. Department of Labor ("DOL") posted
updated Prevailing Wage Determination Policy
Guidance for use in the Nonagricultural
Immigration Programs. The guidance addresses
the H-2B regulation published in December
2008 and the corresponding changes to PERM,
H-1B, H-1B, H-1C and E-3 regulations
governing temporary
professional, non-agricultural or registered
nursing programs.

| IS IT MORE GUIDANCE FOR UNDERSTANDING THE H-1B? CIS Memorandum About Determining Employer-Employee Relationship for Adjudication of H-1B Petitions, Including Third-Party Site Placements. |

Following the receipt of several calls in our
office from companies that sponsor H-1Bs who
had employees sent home at the Port-of-Entry,
a January 8th, 2010 Memorandum from CIS
provides guidance (within the context of H-1B
petitions) about the requirement that a
petitioner establish that an
employer-employee relationship exists and
will continue to exist throughout the
duration of the requested H-1B validity period.

| U.S. HELPING HAITIANS: Temporary Protected Status for Haitians. |

On January 15th 2010, the U.S. Department of
Homeland Security released a Q&A providing
specific guidance to Haitian nationals
interested in taking advantage of Temporary
Protected Status ("TPS"). On the same day,
the CIS
issued a Memorandum that provides interim
field guidance for the various forms of
relief that CIS has
committed to undertake as a result of the
January 12th, 2010 Haiti earthquake.
This guidance will apply to nationals and
habitual residents of Haiti some of who may
fall outside the scope of the TPS designation.

The CIS issued a list of questions and
answers about petition filing and processing
procedures for Form I-140, Immigrant Petition
for Alien
Worker. Topics include requests to change
employers under INA 204(j) and
guidance for successor-in-interest relationship
determinations. These filing guidelines from
the CIS
continue to be helpful to the public.

| NEW PAROLE DOCUMENTS: CIS to Reissue Advance Parole Travel Documents. |

Ooops. The CIS announced that it will reissue
Advance Parole Travel Documents (Form I-512) in
response to documents that were mailed to
applicants with an incorrect issue date of
January 5th, 1990.
