REMINDERS TO NONIMMIGRANT EMPLOYERS: U.S. Employers Should Read The Nonimmigrant Rights, Protections and Resources Pamphlet.

Recent changes to U.S. law relate to the legal rights of employment-based nonimmigrants under Federal immigration, labor, and employment laws, and the information to be provided about protections and available resources. As a temporary visitor to the U.S., it is important that nonimmigrant workers are aware of their rights, as well as protections and resources available when they come to work or study in the U.S. Before the interview, nonimmigrants are encouraged to review the Nonimmigrant Rights, Protections and Resources pamphlet and learn about additional information from the Department of State ("DOS").

Dear Readers:

It is very interesting to note that notwithstanding the fact that the health care reform issue has not been resolved, there still appears to be a push for immigration reform from religious and secular groups.

Much of the "push" for immigration reform is being communicated from the standpoint that health care reform is inextricably linked to immigration-related issues. While this may possibly be the case, another reason for the "push" for immigration reform may be linked to President Obama's recent decline in the popularity polls. Proponents of immigration reform realize the importance of attempting to get the Administration to address an issue while the Administration has high ratings in the popularity polls.

Additionally, timing for addressing immigration reform issues may be ripe since the holidays are a perfect time to have the public think about issues like "family unity" and "freedom from persecution" and issues of "fundamental fairness".

It is at this time of year that we all give thanks. It is also at this time of year that we should all consider that our Nation is "a Nation of immigrants". It was only through the hard work of immigrants and their family members in the U.S. that our Country grew to become one of the greatest Nation's in the world.


  • H-1B VISAS FOR FY 2009-2010 NEARING THE END: Updated Cap Count for H-1B, H-2B and H-3 Workers for Fiscal Year 2010.
  • As of November 20, 2009, approximately 56,900 H-1B cap-subject petitions had been filed. CIS has approved sufficient H-1B petitions for aliens with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. Any H-1B petitions filed on behalf of an alien with an advanced degree will now count toward the general H-1B cap of 65,000. CIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

  • HR MANAGERS SHOULD NOT BE CAUGHT OFF-GUARD: CIS H-1B Site Visits are in Full Swing.
  • For the past few months, the U.S. Department of Homeland Security, Citizenship and Immigration Services ("CIS") has conducted an investigation program aimed at visiting H-1B petitioner worksites throughout the U.S. These site visits began as part of the CIS' goal to decrease the number of H-1B violations and instances of fraud reported by the H-1B Benefit Fraud & Compliance Assessment from CIS' Office of Fraud Detection and National Security ("FDNS"), published this past September. According to the FDNS' findings, as many as one in five H-1B applications were affected by either fraud or "technical violations" of the H-1B program.   • DO YOU E-VERIFY? New Campaign to Recognize Employers Committed to Maintaining a Legal Workforce.
  • Department of Homeland Security ("DHS") Secretary Janet Napolitano today was joined by U.S. Immigration and Customs Enforcement ("ICE") Assistant Secretary John Morton and U.S. Citizenship and Immigration Services ("CIS") Director Alejandro Mayorkas to announce the new "I E-Verify" campaign to recognize the approximately 170,000 businesses nationwide that seek to maintain legal workforces by using E-Verify-DHS' online system to verify employment eligibility of new hires.

  • NEW NORTHERN MARIANA ISLAND RULES: Northern Mariana Islands Transition to US Immigration Laws.
  • The U.S. Department of Homeland Security ("DHS") today announced that at 12:01 a.m. on Nov. 28, the immigration laws of the Commonwealth of the Northern Mariana Islands ("CNMI") will be replaced by the Immigration and Nationality Act (INA) and other U.S. immigration laws. The definition of "United States" in the INA simultaneously will be amended to include the CNMI-providing new privileges and easing restrictions to CNMI residents wishing to live and work in the United States.

  • IMPORTANT CIS PROGRAMS EXTENDED: Law Extends CIS Programs through September 2012.
  • U.S. Citizenship and Immigration Services ("CIS") advises its customers that the Department of Homeland Security ("DHS") Appropriations Act of 2010, signed by the President on Oct. 28, 2009, extends the following CIS programs until Sept. 30, 2012:
    * E-Verify
    * Immigrant Investor (EB-5) Pilot Program
    * special immigrant visa category for non-minister religious workers
    * date by which J-1 nonimmigrant exchange visitors must obtain that status in order to qualify for the "Conrad 30" program.

  • SAVE VIDEO PROMULGATED: CIS Launches Informational Video on the SAVE Program.
  • U.S. Citizenship and Immigration Services ("CIS") today posted an informational video on its Website that provides an overview of the agency's Systematic Alien Verification for Entitlements (SAVE) program.

    The new video describes the immigration status verification process and explains how federal, state, and local benefit-granting agencies can apply to participate in the program. CIS encourages agencies to view the video to determine if the SAVE program is appropriate for their immigration status verification needs.

  • VACCINE ALERT FROM HHS: CIS to Hold Certain Cases Pending Changes to Vaccination Requirements.
  • The Department of Health and Human Services ("HHS"), Centers for Disease Control and Prevention ("CDC") announced on November 13th, 2009 new criteria for determining which vaccinations will be required for applicants seeking to become lawful permanent residents. Based on these new criteria, and beginning on December 14th, 2009, the vaccines for herpes zoster (zoster) and human papillomavirus (HPV) will no longer be required for immigration purposes.
