Dear Readers:

Should we be baffled? History continues to show that any economic downturn has been blamed on the "immigrants". The recent reports about the Lehman Brothers and AIG debacle have focused little on immigrant involvement. Restrictionist Immigration Laws and Regulations are at an all-time high. Enforcement actions by Immigration and Customs Enforcement ("ICE") continue to rise and Removal Proceedings before the Executive Office of Immigration Review ("EOIR") continue to climb. Could it actually be the case that the "paradigm" is wrong? Are the platforms of the Anti-immigrant organizations missing the mark? Perhaps the reason for our Nation's economic woes has more to do with an inability to keep a watchful eye on those with their "fingers in the till". In the go-go 90's the immigration laws were quite liberal. Back then, less restrictionist immigration policies led to significant growth in the U.S. economy. Now is the time, before the Presidential Election, for us to think over the future impact of immigration policies in the U.S. and to study how the candidates address these important issues. Approximately thirty five (35) days and counting . . .

    ICE and DOJ issued a joint press release announcing the raid of an electric transformer manufacturing facility that resulted in the arrest of 595 in Laurel, Mississippi.

    ICE announced that it arrested 23 employees of a major wholesale flower grower in Arcata, California, The Sun Valley Group, on immigration violations.

    ICE Highlights IMAGE, Releases FAQs.

    ICE is highlighting the ICE Mutual Agreement Between Government and Employers (IMAGE) program, which requires employers to enroll in E-Verify and the Social Security Number Verification Service, undergo an I-9 audit, adhere to certain employment practices and sign an agreement with ICE.

    ICE Signs 37 New Partners In IMAGE Program.

    ICE announced that the ICE Mutual Agreement between Government and Employers (IMAGE) program signed on 26 new members to the corporate compliance group that already included nine charter members.

    Seven Federal Contractors Listed for Debarment.

    On 9/12/08 ICE announced that seven companies will be considered for debarment from federal contracting because each was found to be unlawfully employing persons without employment authorization.

    F, M Visa Fee Increase Final Rule.

    This rule adjusts the Student and Exchange Visitor Program (SEVP) school certification petition fees and the application fees for nonimmigrants seeking to become academic (F visa) or vocational (M visa) students, or exchange visitors (J visa). ICE has issued two PowerPoint presentations in connection with the Student and Exchange Information System (SEVIS).

    DOS Issues Final Rule on Inadmissibility of Unlawful Voters.

    DOS issued a final rule implementing the exception in INA Section 212(a)(10)(D) to the ground of inadmissibility for foreign nationals who voted in violation of U.S. law.

    Two Categories of Special Immigrant Religious Workers Due to Expire on October 1st Have Been Extended.

    CIS reminds its customers that authorization for the non-minister special immigrant religious worker program will expire on October 1st, 2008. Individuals applying to serve in the two non-minister categories of the program should either adjust status to permanent residence or apply for, and be admitted with, an immigrant visa before October 1st, 2008, as a precaution.

  • DOL Tries Again to Regulate the Attorney-Client Relationship.

    DOL issues a "restatement" of its earlier Bulletin attempting to regulate the relationship between attorneys and their employer clients in the labor certification context.

    In the latest twist of the audit saga of a major U.S. immigration Firm, DOL has announced that it will apply its August 29, 2008, "guidance" only to recruitment begun after the date of that guidance and that pending audits for this reason will be released.

  • CUSTOMS AND BORDER PROTECTION ("CBP") ISSUES AN UPDATE ON WHTI:
  • Earlier this month, CBP officials participated in a roundtable with reporters to discuss the Western Hemisphere Travel Initiative and to preview the new phase of the WHTI National Public Education Campaign.

    "The agency is committed to implementing WHTI in a common sense, flexible way that facilitates the flow of legitimate travelers and improves the security of our borders," said Assistant Commissioner Thomas Winkowski. "Since the time WHTI was first announced, we have taken seriously our obligation to inform travelers of the change in procedures."

  • U.S. DEPARTMENT OF STATE ("DOS") UPDATES:
  • Scialabba and Neufeld Memorandum on Inadmissibility Due to HIV Infection.

    Late last month, Lori Scialabba, Associate Director, Refugee, Asylum, and International Operations Directorate, CIS, and Donald Neufeld, Associate Director, Domestic Operations, CIS, released a memo on inadmissibility due to HIV infection in light of the President's signing of H.R. 5501.

    New J-1 Program for Korean Students and Recent Graduates.

    On September 22nd, 2008 the DOS announced that it has signed a Memorandum of Understanding ("MOU") with Korea regarding the WEST (Work, English Study, Travel) Program. The exchange program, to be launched in 2009, will allow up to 5,000 university students and recent graduates from the to enter the U.S. for a period of 18 months on J-1 exchange visitor visas.

    DOS Publishes Instructions on Applying for the DV-2010 Program.

    The Congressionally mandated Diversity Immigrant Visa Program makes available 50,000 permanent resident visas annually, drawn from random selection among all entries to persons who meet strict eligibility requirements from countries with low rates of immigration to the United States.

    The DV-2010 Lottery online entry begins at Noon EDT on October 2, 2008, and ends at Noon EST on December 1, 2008.
