Worker's Comp Not Holding This Claimant Back from Seeking Employment
Claimant alleged a head injury after a fall while working for the insured. Surveillance was established at the Claimant's residence on various dates and times. The Claimant was observed moving items in the trunk, bending over to pick an item off the ground and operating a vehicle that had been parked at his residence. On another surveillance occasion, the claimant was observed driving to several stores, loading groceries from a cart to the vehicle and pumping gas at a gas station. Claimant was also viewed dropping off several individuals at a local library and drove off with the rear passenger door open. The investigator observed the claimant reach from the front driver's seat to the rear of the car to shut the door from the inside.

The claimant operated his vehicle and drove to a restaurant where he was overheard by the investigator discussing training to work at the restaurant. He appeared to be working behind the counter while at the restaurant.
At no time during the duration of the surveillance did the investigator observe any disability, restrictive movements or any implication of a medical condition. It appeared that the claimant was training to work at the restaurant. |
