Legislative Term of the Week:
 
Revenue Estimating Conference: A group that estimates the general fund revenue due the state for the current year and the next budget year.  The REC meet quarterly, and the Governor and Legislature are required to use the REC estimates in preparing the state budget.  The REC is comprised of the Governor or designee, the LSA or designee, and a third person agreed to by the other two members.

Read this news release from the Iowa Senate Democrats and their plans to expand health care coverage to Iowa families.  
Greetings!
Next week is funnel week which means that March 13th is the final date for Senate bills to be reported out of Senate committees and House bills out of House committees.  Funnel dates are self imposed deadlines set by the House and the Senate.  What does this mean?  Bills have to get out of Committee or they are dead for the year.  There is always a chance they (bill language) might appear in an appropriations bill later this session.  The March 13 committee deadline does not apply to Appropriations Bills, Ways and Means Bills, Government Oversight Bills or bills co-sponsored by Majority and Minority Leaders of one House.
 
Between the two chambers there were well over a hundred subcommittee meetings this week with many more next week.  The Committees were also busy and will be so next week.   
 
You will notice several new bills listed below, some have subcommittee meetings assigned while others don't so they may be DOA (dead on arrival).
 
Speaking of DOA, lots of talk this week as the Dept. of Elder Affairs officially changed their name thru legislation that passed on Wednesday to the Dept on Aging.  Acronym being DOA.  We all need a little humor these days at the Capitol.  Although some found it not so amusing.  The Director of the Agency did say they will use DA as their acronym and not DOA.
 
One last important item.  We are unable at the time to move HF 288 out of subcommittee.  Please read this legislative alert regarding predatory lending and take action today.

CHIP
There continues to be good news about the CHIP Reauthorization Act (CHIPRA) that President Obama signed in early February. There are many new and exciting parts of the bill. Georgetown's Center for Children and Families has some great information regarding CHIP on their website.
 
A few key points:
  • The bill allows states to cover legal permanent resident children and pregnant women and eliminates the five-year bar. It is now a state option and states will be reimbursed for allowing that coverage. We are working hard in Iowa to assure that we offer that here.
  • The bill allows for reimbursement for translation and interpretation services under Medicaid and CHIP. Allowable services include: when an individual enrolls in coverage, renews coverage, and utilizes coverage.
  • The bill allows states to create a dental-only option under their CHIP plans for children who have medical but not dental coverage. We are also trying to get that created in Iowa this year.
  • The bill includes performance bonuses to encourage states to enroll more currently eligible but unenrolled children. These bonuses are contingent on states implementing, throughout the fiscal year, at least five of eight simplification measures related to enrollment and renewal. As you know, we've always worked hard on this in Iowa, but we can do more. We are hopeful that we will enact more strategies so that we will be eligible for the bonus money.
  • There will be outreach funds ($90 million) available to state and local governments, federally qualified health centers, disproportionate share hospitals, federal-public programs that serve children (like WIC or school lunch), faith-based groups, community-based groups, or schools.  The guidance for this outreach money has not yet been released.

American Recovery and Reinvestment Act

The Iowa Legislative Services Agency posted two helpful documents on the Iowa General Assembly website earlier this week.  One is an overview of the Federal Assistance to Iowa and the other is allocations to Iowa sorted by budget subcommittees.

HF 7-  An Act establishing a parental involvement grant program and making an appropriation.  Referred to Education.  Subcommittee, Abdul-Samad, Bukta,and Sweeney. Subcommittee passed bill on 1/21.  Referred to Approps

SF 8 - Act relating to transportation provided to children attending
a preschool program administered by a community empowerment
area.  Referred to Education.  Subcommittee, Appel, Feenstra, and Sodders.
 
SF 6 - This bill lowers the compulsory school attendance age from age six to age five. The bill makes a number of conforming changes, including the elimination of language establishing the conditions under which a child may be admitted to kindergarten and first grade in a public school.  Introduced, referred to Education. Subcommittee, Heckroth, McKinley, and Sodders met on 1/20.
 
HF 100 - Requires that a child who turned 5 after the September 15 deadline for starting kindergarten be enrolled if the child was enrolled in another state and the child's parent makes a request.  Allows a child who turns 5 after the deadline to be enrolled if the child demonstrates sufficient ability on DOE evaluations.  Referred to Education
 
HF 156 - An Act providing an appropriation for a pilot project to implement a child care center that operates twenty=four hours per day, seven days per week.  Subcommittee - Heddens, Gayman and Heaton. 
 
HF 562 - (formerly HF 383 )- STATE CHILD CARE ADVISORY COUNCIL -Requires one of the seven members of the Council on Human Services to be a member of the Child Care Advisory Council. Makes changes to the membership on the council, including that a slot for an unregistered child care home provider be for a "family, friend, and neighbor child care" provider.  Identifies four additional slots for the advisory council (business, from nominees by the Chamber of Commerce executives, community empowerment office, and Iowa after-school alliance, the statewide preschool program for four-year-old children).  Allows the council to advise the DHS on additional matters, including the federal Child Care and Development Block Grant and other funding sources.  Requires the DHS to give the council various financial information.  Requires the council to make reports to the DHS and the Governor.   Introduced by Representative Petersen, et al.  UPDATE - Passed Out of Committee on March 2nd.  Eligible for debate in House.
 
SF 179 - An Act providing for a pilot project supporting high=quality child care for low=income children.  Introduced by Senator Bolkcom.  Referred to Human Resources. Subcommittee, Bolkcom (C), Boettger , Schmitz  UPDATE - Sub meeting on 3/10 @ 11:30 in Senate lounge.
 
HF 357 - An Act relating to preschool support provided through school ready children grants under the community empowerment initiative.  Introduced by Rep. Kaufmann.  Referred to Education.  Subcommittee, Steckman, Tymeson, and Winckler 
 
HF 419 - An Act relating to regulation of child care by the department of human services by providing for licensing of child development homes, establishing a regulatory fee and appropriating the fee proceeds, making penalties applicable, and providing effective dates.  Subcommittee, Mascher, Petersen and Soderberg.  UPDATE - Human Resources Committee began debate on Wednesday but didn't complete the debate.  They will pick up again on Monday, March 9th.

HF 467 - An Act providing for colocation of early care services available through the community empowerment initiative.  Introduced by Schulte.  Subcommittee, Frevert, Drake, and Isenhart
 
HF 563 - An Act providing for implementation of a voluntary licensure system for certain home=based child care providers.  Introduced by Heaton.  Subcommittee, Mascher, Petersen, and Schulte
 
HF 565 - An Act providing for a state research and development prekindergarten through grade twelve school.  Subcommittee, Kelley, May, Schulte, Wendt, and Winckler.  Sub meeting on 3/10 @ 9:00 in House lounge.
 
HF 537 - An Act requiring a national criminal history record check for certain child care providers and making penalties applicable.   Subcommittee, Mascher, Baudler, and Petersen.  Slight possibility this could be an amendment to HF 419 (debated in Human Resources on Monday)
 
HF 513 (also HF 508) - An act requiring the availability of electronic billing and payment for providers under the state child care assistance program.  Subcommittee, Petersen, Alons, and Steckman.  Sub meeting on 3/9 @ 9:00 in House lounge.
 
Child Well-being and Development 
 
HF 234 - A study bill for requiring health insurance coverage for costs relating to mental health conditions, including alcohol or substance abuse treatment services, and creating a mental health insurance advisory committee. Eligible for debate in the House.  Companion Bill - SF 16  Subcommittee, Schmitz, Quirmbach, and Seymour
 
HF 56 - An Act relating to early childhood immunizations for influenza containing mercury and making penalties applicable.  Referred to Human Resources.  Subcommittee, Wendt, Koester, and Steckman.
 
HF 63 - An Act relating to the dental screening program for children 2 enrolling in elementary or high school.  Referred to Human Resources.  Subcommittee, Mascher, Alons, and Hunter.
  
SF 48 - An Act relating to health care, health care providers, and health care coverage, providing for appropriations, providing penalties, and providing retroactive and other effective dates.  Has many divisions - one of interest may be - IOWA CHOICE INSURANCE EXCHANGE.  Division II of the bill contains new Code chapter 514M.  The purpose of the chapter is to ensure that all children and all other Iowans in the state have affordable, quality health care coverage, and to decrease health care costs and health care
coverage costs.  UPDATE -  Passed out of Committee on 3/4 stripped of the undocumented children provisionbut other good provisions still within bill.
  
HF 187  Prohibits foster care parent from providing child care if a foster child is present who has been found by the DHS to have abused another child.  Referred to Human Resources.  Subcommittee - Mascher, Petersen and Forristall
 
HF 382 - A study bill relating to the public health system by providing for the voluntary accreditation of certain public health agencies, the adoption of Iowa public health standards, the establishment of an accreditation data collection system, creating a fund, and providing for a penalty and an effective date. 1-29-09. Passed House Human Resources Committee.  Eligible for debate in House.  Companion Bill  SSB 1103
 
HF 202 - An Act relating to the assignment of health care coverage and dental care coverage benefits.  Referred to Commerce.  Subcommittee, T. Olson, Petersen, and Sorenson
  
HF 255 - An Act providing for mandatory universal newborn and infant eye
examinations.  Introduced by Rep. Gayman.  Subcommittee, Hunter, Mascher, and L. Miller. Subcommittee on 2/16 @ 4:00.  Subcommitte met and did not vote bill out of committee.

HSB 223 - CHILD HEARING AIDS-Requires insurance contracts to include coverage for hearing aids and audiological services for children, up to the age of 18, including requiring hearing aids every two years and up to three additional ear molds a year. Referred to Commerce. Subcommittee - T Olson (C), Petersen, Pettengill

 
HF 448 - A bill for an act requiring testing and abatement of lead hazards in certain residential dwellings and child care facilities, requiring inspections of certain residential housing for lead hazards prior to sale, establishing a childhood lead poisoning prevention and control committee.  Referred to Human Resources.  Sponsored by Ford, Hunter, Smith and Petersen.  Companion bill  SF 213.

HF 36 - An Act relating to relocation of the child support recovery unit to the department of revenue.  Subcommittee, Lensing, Isenhart, and Pettengill.

SF 137 - An Act providing that wage discrimination is an unfair employment
practice under the Iowa civil rights Act and providing an enhanced remedy.
  Voted out of State Government.  Passed Senate on 2/16 on a vote of 32 - 18.  Moved on to House and referred to State Government.
